Melbourne claims require more than a hurricane label

Brevard County’s emergency guidance identifies storm-surge exposure along the Indian River Lagoon system, including Melbourne. It also explains that storm-surge maps, FEMA flood insurance maps and evacuation maps serve different purposes. For an owner challenging a water-damage decision, that distinction matters: an evacuation designation is not a finding about the cause of damage inside the insured building.

Start the claim file with observations at the property. Record whether water rose outside, appeared beneath damaged roofing, entered around a window or came from an indoor fixture. Keep the inspection findings and the photographs together, with dates and room names. A flood-zone designation can be useful background while still leaving important questions about what occurred during your loss. We examine the property and flood policies separately where relevant, rather than use a broad weather description to decide which repairs are potentially covered.

Reviewing a commercial roof insurance claim in Melbourne

For a commercial property roof damage claim, identify the building owner, named insured, damaged roof areas and the precise insurer response. Give the attorney the complete policy, including endorsements and any written repair election. A contractor’s proposal should explain the condition supporting each repair method. Photographs of the roof surface are useful alongside findings about insulation, decking, openings and the interior areas affected, where those components were actually inspected.

Krapf Legal can compare the supported scope with the insurer’s allowance, looking at missing work as well as pricing and policy terms. Keep business losses and tenant losses separately documented, and identify any other insurer handling part of the event. If the disagreement concerns a residential roof instead, the same need for reliable cause and repair evidence remains. Hail, hurricane wind and deterioration allegations require a documented explanation; the existence of a roof leak alone does not answer every coverage question.

Find the Melbourne flood and repair records that fit your address

Melbourne’s Flood Hazard Information page directs owners to FEMA’s Flood Map Service Center and elevation-certificate resources. It also discusses proposed flood-hazard determinations for Brevard County and incorporated areas. Confirm which map is effective for the address and relevant date before relying on a preliminary designation. Retain the map panel information or written determination with the rest of the property records.

The Melbourne City Clerk identifies the office as custodian of city records. An owner can ask for available records concerning earlier roofing, additions or repairs, describing the property address, approximate work dates and documents sought. Request the relevant permit and inspection history rather than assume every record appears in one online search. Compare whatever is available with contractor invoices and photographs. These materials can clarify the sequence of work when an insurer attributes damage to an earlier condition, but a completed permit does not independently prove the cause of a later leak.

04

Organize interior, fire and association losses by insured interest

A Melbourne property damage claim may involve more than the exterior repair. Provide separate descriptions of affected rooms, damaged contents, temporary protection and any claimed loss of use. For fire or smoke damage, retain the available incident documentation, cleaning proposals and inventory. For suspected mold, include the inspection and remediation records with their dates. We review the policy’s wording and the insurer’s stated reasons without treating every post-loss expense as an insured charge.

For an HOA or condominium insurance dispute, explain whether advice is sought by an individual owner or by the association. Bring the governing documents, master policy, unit policy if relevant, and communications identifying responsibility for repairs. Keep board estimates distinguishable from an owner’s interior proposal. This lets the discussion focus on the particular coverage or association issue instead of assuming the same contract insures every party’s property. Krapf Legal can assess the documents and discuss whether representation fits the dispute presented.

Insurance deadlines and the Brevard County court framework

Florida Statutes section 627.70131 generally gives a residential property insurer 7 calendar days to acknowledge a claim communication and establishes a 60-day pay-or-deny period for covered categories of claims, measured from notice. The payment rule reaches specified commercial claims, including structural or contents claims involving buildings of 10,000 square feet or less; it is not a blanket promise for every commercial building. Exceptions, tolling and limits on acknowledgment duties for represented claimants require review.

Section 627.70132 generally requires initial or reopened property-claim notice within 1 year of loss and supplemental notice within 18 months. Special provisions and policy dates can affect applicability. Section 95.11(2)(e) generally measures the five-year limitation for a property-contract lawsuit from the loss date. Do not substitute that suit period for the earlier reporting obligation, or assume a flood policy follows the same process.

Before qualifying litigation, section 627.70152 requires notice through the department at least 10 business days before suit and after a coverage determination. Brevard County is in the Eighteenth Judicial Circuit; filing there still depends on jurisdiction and venue. Florida’s one-way attorney-fee entitlement for property policies was removed. Review the fee agreement and case expenses, and ask whether any other fee authority applies to the specific case.

Prepare for your evaluation

Records to have ready
for your evaluation.

Start with your policy, claim number, and the insurer’s latest response. For your Melbourne property, these additional records may help:

  • Melbourne street address, property ownership details and the declarations for each residential, commercial or flood policy.
  • Commercial roof plans or measured scopes, inspection photographs and the building size needed to assess statutory claim-handling rules.
  • Effective FEMA flood-map information for the Melbourne address, distinguished from preliminary and evacuation mapping.
  • Available Melbourne city permit and inspection records, paired with invoices for earlier work on the damaged component.
  • Room-by-room interior evidence, business or household expense records and any relevant condominium or HOA repair communications.

Don’t delay contacting us because a record is missing. We can discuss what you have and what may be needed.

Common questions

Your Melbourne
questions, answered.

Answers to questions about getting help with a Melbourne property insurance claim.

Is there a Krapf Legal office in Melbourne?

Representation for Melbourne owners is provided from the firm’s Clearwater office, located at 2790 Sunset Point Road. Send the property address and the insurer’s decision with your request for a claim review. Identifying the building and policyholder first helps distinguish a household claim from a commercial or association matter.

Can you assess a denied Melbourne commercial roof claim?

Yes. The review can examine the contract, cause findings, insurer’s explanation and the contractor’s proposed work. Supply all endorsements and identify which roof areas remain disputed. Include any related interior damage and business records without assuming those items share the same coverage or valuation method.

Does the 60-day statute cover every commercial building?

Section 627.70131(7) includes specified commercial claims involving structures or insured tenant premises of 10,000 square feet or less, with additional limits and exceptions. A Melbourne business owner should provide building size, coverage details and notice dates before treating the 60-day provision as applicable to the claim.

Where should I start with Melbourne flood-map information?

The city’s Flood Hazard Information page links to FEMA mapping and elevation resources. Distinguish proposed changes from the effective map for your address. Brevard also warns that surge, evacuation and flood insurance maps differ; none of those map labels replaces evidence of the water source at the property.

Can earlier Melbourne repair records help with an old-damage dispute?

They may help establish what work was authorized or inspected and when. Ask the City Clerk’s office about available records, specifying the address and relevant dates. Match those documents with photographs and contractor findings so the file explains both the earlier work and the condition associated with the present claim.

What changes if the claim involves a Melbourne condominium?

Identify whether the dispute concerns the association’s insured building, the owner’s insured unit or both. Bring the policies and governing records before drawing conclusions about repair responsibility. Section 627.70132 also provides special notice rules for qualifying loss-assessment coverage, so assessment dates and board paperwork can matter.

How long do I have to sue over a property-policy breach?

Section 95.11(2)(e) generally provides five years from the loss for that contract action. Reporting deadlines under section 627.70132 are earlier and separate. Counsel should check the applicable policy dates, any exceptions and the pre-suit process promptly rather than calculate the lawsuit period from the denial letter.

Which local circuit handles a qualifying Melbourne insurance case?

A case with proper Brevard County venue and circuit-court jurisdiction falls within the Eighteenth Judicial Circuit. Court selection also depends on the amount and other jurisdictional facts, including any federal basis. Where the law firm maintains its office does not by itself decide the filing location.

Absolutely phenomenal work and effort. They worked to help us fight our insurance company that refused to pay us what was owed, and got us a fair settlement. Hopefully I will never need a lawyer again but if I did, this is who I would call.

After our insurance company dismissed our hurricane-caused roof damage/leak claim as "age-related deterioration/wear and tear". we were referred to Krapf Legal. The Krapf Legal team were exceptional throughout the year-long battle to ensure we were compensated for our significant losses. Our attorney, Tim Delaney, was always reachable, professional and courteous - and he negotiated the exact settlement we were looking for to cover 100% of our roof replacement.

Dear family and friends, I highly recommend Mike Keeler from The Claim Squad and Geoffrey Schuessler from Krapf Legal for their exceptional service in handling my homeowner's insurance claim. Their professionalism and expertise were remarkable, especially considering the new laws that have become increasingly burdensome to homeowners since January 1st, 2023. Throughout the process, both Mr. Keeler and Mr. Schuessler demonstrated honesty and forthrightness, which I found commendable. I am grateful for their efforts in resolving my insurance claim and impressed by their dedication to their work and clients. If you need assistance with an insurance claim, I highly recommend the services of Mr. Keeler and Mr. Schuessler. Their expertise and professionalism are second to none, and I am confident that they will provide exceptional service to all. Thank you for your attention to this matter. Best regards, Taylor Taylor

In a time where we had lost hope, Keller Fisher from Krapf Legal stepped in and led us to a settlement that would allow my widowed mother in law to get the repairs that were much needed on her roof. We were denied the claim twice. We called Krapf Legal and within no time they had begun a claim with my insurance company and got it settled. Keller was professional, courteous, prompt, and available with any questions or concerns we had. I'd recommend this gentleman to anyone who is experiencing issues with their insurance company. I can't thank Keller enough for all the hard work he and his team put forth in to getting this case settled.

I had a great experience using Krapf Legal to help me settle my home insurance claim. I had provided my insurance company with everything they requested, but their offer was way less than the estimates I had to fix the damage to my house I had been waiting for almost a year for the insurance company to respond to my claim. I called Grant and he said he would take care of it, and he did! The team at Krapf legal was able to quickly settle my claim.

Our home has survived many Florida hurricanes but when a strong, surprise hail storm hit in early 2020, our house suffered substantial damage. Our homeowner’s insurance company had a team of experts on their side to fight our claim. When weeks turned into months, we knew we needed someone to represent our needs. Krapf Legal came highly recommended and we now understand why this team has earned its outstanding reputation. Every Krapf Legal representative has been so professional, understanding and so passionate about helping homeowners like us. While we live several miles away in another city, the Krapf legal team (Grant, Keller and the entire team) treated us like neighbors. They were professional, responsive and spot on with their advice. In the end, we received the compensation we needed to repair our home. Truly, we couldn’t have resolved our claim with such a positive outcome without Krapf Legal. Thank you!!!

I had extensive damage to my home from Hurricane Irma. My insurance company only stated $8k worth of damage but because my deductible was so high they sent me a check for $3k! I couldn't even get the insurance company to return my phone call for 3 months! I didn't know what to do so I hired an insurance adjuster to fight the claim. After over a 16mths of fighting it had finally gotten to the point to bring in a lawyer. They recommended Grant Krapf and I’m so glad they did! I couldn’t believe how quickly he got a response from the insurance company. In total, I had been waiting for nearly 2 years and when Grant and his team came on board it was a matter of months before they were able to get the insurance company to settle. I was shocked and amazed! I have never hired an attorney before and I had always heard unflattering stories but this was not my experience. Even after the settlement they have been kind enough to still help me with questions or advice relating to the house. They are good people and they do good work! It’s incredible when you feel like you are going up against a giant and want to give up and can find extraordinary people that will fight for you and never give up!
