Wind and rain
A damaged roof or opening may affect ceilings, wall finishes and belongings below. Connect those areas in the inspection record instead of presenting the roof as the entire loss.
Extended flooding
On October 3, 2022, Osceola still warned of changing flood conditions around Kissimmee and East Lake Tohopekaliga after Ian. Keep dated observations from successive days if a property’s damage continued after the initial roof or wind inspection.
Incomplete estimates
A brief inspection may not resolve every room or repair task. Identify the omitted areas and obtain findings explaining the work proposed before comparing the final totals.
An Osceola owner may need help after a hail inspection, a water-damage denial or an estimate that omits necessary interior restoration. Describe the loss and where the claim stands. An insurer’s request for documents, a coverage denial and a payment with depreciation withheld have different implications and should not be treated as the same response.
Tell us whether the property is owner occupied, rented, a condominium or used for business. The legal review can examine the insured interest, coverage wording and evidence for the loss. If representation is appropriate, we can discuss the work needed to pursue the dispute and available options for resolution.
More about property damage insurance claimsOsceola’s Ian recovery continued after the wind passed: the county’s October 3, 2022 update described changing water levels around Kissimmee and East Lake Tohopekaliga. A claim may need to distinguish an early roof leak from water arriving later. Krapf Legal reviews the damage timeline and the repair work an insurer has denied or omitted.
In Kissimmee or St. Cloud, an owner may first discover storm damage as water on a ceiling or floor inside the home. An inspection should address the exterior entry point as well as the affected room. Photos of an interior stain alone may not explain why roofing or an opening needs repair.
Ask the contractor to show how the proposed exterior work relates to the observed condition. Then compare the interior scope: which surfaces are affected, what restoration is proposed and which items the insurer accepted. Keeping those explanations together helps prevent a roof-only discussion from overlooking supported interior damage.
Roof damage insurance claim guidance Roof leak insurance claims in FloridaOsceola’s October 3, 2022 Ian update described water levels still changing around Kissimmee and East Lake Tohopekaliga after the storm crossed the area. For an affected owner, an inspection during the first day may not describe the building’s condition several days later. Keep the initial roof or wind findings and add a dated record of any later ground-level water rather than replacing the earlier account with one broad flood description.
If conditions changed, preserve a sequence of observations: the first roof leak, water outside, ground-level entry and any later rooms affected. Describe only what you know. Rain entering through a damaged building and rising water can raise different insurance issues, so the inspection should address the pathways rather than assign one cause to all wet materials.
A water-removal bill and a permanent repair estimate may describe different parts of the same recovery. Ask what each document covers. A drying charge does not explain whether damaged flooring, wall finishes or cabinetry also needs repair, while a reconstruction estimate should identify the findings supporting that work.
For each disputed room, keep a small set of photos, the inspection findings and the relevant estimate lines together. Add receipts for temporary protection and other claimed expenses with a note explaining their purpose. This organization helps distinguish missing work from a pricing disagreement and gives a legal review more than two unexplained totals.
If the insurer denies damage as unrelated, ask which finding supports that conclusion. If it accepts the event but offers less than the repair proposal, identify the scope differences. The response needed for a cause dispute may be different from the evidence needed to explain omitted rooms or quantities.
Krapf Legal reviews the policy, the insurer’s written position and the property evidence together. Bring the current estimate as well as earlier versions and any payments received. We can identify the unresolved questions and discuss legal options based on the actual claim, without assuming that local storm history proves an individual loss.
A hail report near Kissimmee can explain why an inspection was requested, but it does not establish damage to your particular roof. Ask the inspector to identify the affected material and distinguish impact marks from age, deterioration or other causes. Preserve clear images and the explanation linking the findings to the reported event.
Include exterior components actually affected and any resulting leak path into the building. If the insurer accepts some work but rejects the rest, obtain a separate explanation of the disputed items. The needed response may be a supported repair-scope comparison rather than another general weather report.
Hail damage claim evidence and coverageFor a Kissimmee or St. Cloud property where damage developed over several days, preserve the sequence of observations. Describe roof-entry leaks, ground-level water and professional findings separately. Keep homeowners and flood claim correspondence in distinct folders while recording any overlap in damaged components or payments.
This organization helps when the insurer attributes every wet item to one cause. Do not assume the earliest inspection captured all later conditions, and do not assign a cause to concealed damage without support. New findings should be communicated promptly, with attention to the policy and applicable reporting rules.
If an Osceola property was rented or used as a vacation home, provide the relevant policy and explain occupancy at the time of loss. A property manager’s dated messages, inspection records and repair authorizations may help establish when damage was discovered and what mitigation occurred. Vacancy or rental provisions can matter to the review.
Keep building repairs separate from damaged furnishings and any claimed lost rental income. The coverage and proof required for those items may differ from an owner-occupied household’s additional living expenses. A canceled reservation alone does not establish an insured income loss, just as a construction estimate alone does not inventory every damaged belonging.
Compare the insurer’s scope, the contractor’s supported revisions and all payments already received. Note unresolved rooms, quantities and causes. Retain signed work authorizations and any document that directs payment or transfers rights, so the attorney can understand other obligations affecting the claim.
Our Clearwater team can discuss an evaluation for your Osceola property and how to provide the available records. Ask about the next step, its evidence requirements and the proposed written fee terms. A pending evaluation does not extend reporting or legal deadlines, including those affecting an older Ian-related dispute.

Common questions
Answers to questions about getting help with a Osceola County property insurance claim.
The county’s Ian updates show that water conditions can keep changing after the wind ends. For a Kissimmee or East Lake-area claim, dated photos may help distinguish the initial roof leak from later water reaching a doorway or floor. Retain each inspection and estimate version so the insurer can address newly observed damage. Only property-specific evidence can establish what happened at your building.
Identify the missing rooms and obtain findings showing the damage and proposed repairs there. Photos should be labeled so they can be matched to the scope. Krapf Legal can examine whether the insurer’s explanation addresses those areas and the evidence submitted.
Yes. Both can help explain how the repair assessment developed. Ask the contractor to identify additions or changed quantities and the findings behind them. That history helps clarify whether the dispute concerns newly documented damage, different pricing or work omitted from the original inspection.
We can review the denial or repair allowance with the roof inspection, photographs and policy. Ask the professional to explain the observed impact damage and the proposed repair. A nearby hail event supports context but does not establish that every roof component is damaged or covered.
Keep a dated description of where water first appeared and separate findings for the roof, openings and ground-level entry. Include any flood policy and its claim records. Different causes can affect the same room, and the allocation should follow the evidence and policy terms rather than a single broad label.
A legal review can examine the actual policy and use of the property. Provide rental or occupancy records, property-manager communications and the claimed repair or income loss. Coverage intended for an owner-occupied home should not be assumed to cover every rental activity or interruption.
Check the declarations, endorsements, applicable sublimits and the explanation of how the limit was applied. A difference between the repair price and available coverage can remain even when a claim is accepted. We can review whether the insurer used the right provision without promising payment beyond the contract.

Krapf Legal offers a free case evaluation. If we agree to represent you, ask for the written fee agreement and an explanation of attorney fees, case expenses, and any amount you could owe if there is no recovery. A free evaluation does not mean every stage of a case is free, and the insurer is not automatically responsible for your legal bill.
For many Florida property claims, current law requires notice of a new or reopened claim within one year of the loss and a supplemental claim within 18 months. These are notice rules, not the deadline to sue. Exceptions and special rules, including some condominium loss assessments, can apply. Earlier losses and flood policies need separate analysis. Have the loss date, policy and prior notices reviewed promptly; ongoing negotiations do not automatically extend a deadline.
Follow the policy’s notice requirements promptly and truthfully; do not wait for a perfect repair estimate. Give the facts you know, identify uncertainty, and keep a copy of what you submit. Protect the property safely from further damage and retain receipts. A later inspection can clarify the scope, but missing a notice requirement can create a separate dispute.
It depends on what the payment and any accompanying agreement mean. An undisputed payment, a payment subject to further documentation, and a full settlement with a release can have different consequences. Have the check language, payment letter, releases and prior agreements reviewed before assuming you can pursue more money. Keep records of every amount received and how it was allocated.
Some disputes can be addressed through better documentation, another inspection or negotiation. Eligible claims may have a mediation option; a policy may also provide appraisal for certain valuation disagreements. Appraisal does not resolve every coverage question. Litigation may be appropriate when other steps do not resolve the dispute. Your policy, deadlines, evidence and goals determine which options warrant consideration.
Yes. A public adjuster can assist with presenting and adjusting a property claim within that profession’s permitted role. A lawyer can advise on legal rights, interpret disputed policy terms and represent you in litigation. If you already have an adjuster or contractor, bring the agreement and work completed so the legal review accounts for the existing arrangement.
No. A denial or a low payment can involve a genuine coverage or valuation dispute. Bad faith has additional legal requirements and cannot be assumed from the outcome of an inspection. Keep the complete communication history and ask counsel to evaluate the policy dispute and any potential claim-handling issues separately.
There is no dependable timeline without reviewing the claim. The insurer’s statutory handling duties, requests for information, inspections, negotiations and any court proceedings are different stages. The extent of disputed damage and the availability of evidence also matter. Ask what the next step requires, who is responsible for it, and how you will receive updates rather than relying on a promised settlement date.
No. Section 95.11 generally gives five years from the date of loss for an action alleging breach of a property insurance contract. That does not extend shorter claim-notice or policy deadlines. The two-year negligence period often discussed after HB 837 concerns a different cause of action; it should not simply be substituted for the insurance-contract rule. Flood, bad-faith and insurer-insolvency matters can involve different rules. Have counsel check the policy, loss date, claim type and applicable law promptly rather than calculate a filing date from a general summary.
For claims subject to Florida’s current handling statute, an insurer generally must acknowledge a claim communication within seven calendar days and pay or deny a claim, or a portion of it, within 60 days after receiving notice. Exceptions, tolling, the type of policy and special rules for represented policyholders matter. These are claim-handling duties, not a promise that litigation finishes in 60 days. Keep the notice date, information requests and responses so an attorney can assess the applicable timeline.
A first-party claim seeks benefits from your own insurer under your policy. Homeowners, condominium unit-owner, renter, landlord, association and commercial contracts can insure different property and interests. For example, an HO-3 homeowners policy and an HO-6 unit-owner policy are not interchangeable. Bring the declarations and all endorsements, identify who owns the damaged items, and keep any separate flood policy with the file. The policy name alone does not determine coverage.
A claim for benefits and a potential bad-faith claim involve different requirements. A repair estimate above the limit does not itself create a right to extra-contractual damages. For a Florida property insurer, statutory prerequisites and the claim history must be evaluated before pursuing bad faith. Ask counsel to separate unpaid covered benefits from any other proposed remedy and explain the evidence required; additional recovery cannot be assumed from a denial or low offer.

A very well run law firm if you have a gripe with your homeowners insurance.
After our insurance company dismissed our hurricane-caused roof damage/leak claim as "age-related deterioration/wear and tear". we were referred to Krapf Legal. The Krapf Legal team were exceptional throughout the year-long battle to ensure we were compensated for our significant losses. Our attorney, Tim Delaney, was always reachable, professional and courteous - and he negotiated the exact settlement we were looking for to cover 100% of our roof replacement.
Dear family and friends, I highly recommend Mike Keeler from The Claim Squad and Geoffrey Schuessler from Krapf Legal for their exceptional service in handling my homeowner's insurance claim. Their professionalism and expertise were remarkable, especially considering the new laws that have become increasingly burdensome to homeowners since January 1st, 2023. Throughout the process, both Mr. Keeler and Mr. Schuessler demonstrated honesty and forthrightness, which I found commendable. I am grateful for their efforts in resolving my insurance claim and impressed by their dedication to their work and clients. If you need assistance with an insurance claim, I highly recommend the services of Mr. Keeler and Mr. Schuessler. Their expertise and professionalism are second to none, and I am confident that they will provide exceptional service to all. Thank you for your attention to this matter. Best regards, Taylor Taylor
In a time where we had lost hope, Keller Fisher from Krapf Legal stepped in and led us to a settlement that would allow my widowed mother in law to get the repairs that were much needed on her roof. We were denied the claim twice. We called Krapf Legal and within no time they had begun a claim with my insurance company and got it settled. Keller was professional, courteous, prompt, and available with any questions or concerns we had. I'd recommend this gentleman to anyone who is experiencing issues with their insurance company. I can't thank Keller enough for all the hard work he and his team put forth in to getting this case settled.

Our home has survived many Florida hurricanes but when a strong, surprise hail storm hit in early 2020, our house suffered substantial damage. Our homeowner’s insurance company had a team of experts on their side to fight our claim. When weeks turned into months, we knew we needed someone to represent our needs. Krapf Legal came highly recommended and we now understand why this team has earned its outstanding reputation. Every Krapf Legal representative has been so professional, understanding and so passionate about helping homeowners like us. While we live several miles away in another city, the Krapf legal team (Grant, Keller and the entire team) treated us like neighbors. They were professional, responsive and spot on with their advice. In the end, we received the compensation we needed to repair our home. Truly, we couldn’t have resolved our claim with such a positive outcome without Krapf Legal. Thank you!!!

The team at Krapf Legal is a group of dedicated professionals that bring significant contribution and value to their clients. They are highly responsive, communicate expectations effectively and more importantly, get timely results for the folks that they represent. I highly recommend this firm, whether working with them directly or through a public adjuster.
I had extensive damage to my home from Hurricane Irma. My insurance company only stated $8k worth of damage but because my deductible was so high they sent me a check for $3k! I couldn't even get the insurance company to return my phone call for 3 months! I didn't know what to do so I hired an insurance adjuster to fight the claim. After over a 16mths of fighting it had finally gotten to the point to bring in a lawyer. They recommended Grant Krapf and I’m so glad they did! I couldn’t believe how quickly he got a response from the insurance company. In total, I had been waiting for nearly 2 years and when Grant and his team came on board it was a matter of months before they were able to get the insurance company to settle. I was shocked and amazed! I have never hired an attorney before and I had always heard unflattering stories but this was not my experience. Even after the settlement they have been kind enough to still help me with questions or advice relating to the house. They are good people and they do good work! It’s incredible when you feel like you are going up against a giant and want to give up and can find extraordinary people that will fight for you and never give up!
Highly recommend Krapf Legal. Cailtin has always greeted us in a friendly and professional manner and made us feel like a very important client. Grant and his staff were always prompt to address our needs and timely respond to any questions. Very knowledgable, respectful, reliable, courteous and professional.
Grant and his team consistently achieve great results for their clients. They are people you can trust and always act in their client’s best interest.
