Jacksonville losses can involve river water and wind damage

The National Weather Service’s Hurricane Irma report documents historic St. Johns River flooding in September 2017, including impacts in Riverside, San Marco and downtown Jacksonville. The city’s floodplain guidance also identifies coastal, inland and tributary flooding. Those records explain why a Jacksonville claim should begin with the water’s route into the building rather than an assumption that distance from the beach settles the question.

For a current dispute, assemble observations specific to your address: water marks near the floor, rain entering above a ceiling, exterior openings and the order in which each condition appeared. If a professional inspected the roof or traced the water source, preserve the complete report with its photographs. Historical storm reporting supplies context; it cannot establish the cause of your particular loss or show that every damaged component falls under the same policy. A lawyer can compare the supported causes with the insurer’s position.

What a Jacksonville property damage lawyer examines

An insurance dispute may turn on a missing repair item, an exclusion, an unresolved investigation or the way a deductible was calculated. Krapf Legal starts with the complete contract and the written claim decision. For roof damage, provide the inspection findings alongside the estimate so the proposed work can be evaluated against the condition actually documented. For indoor water, identify the affected rooms and the evidence connecting them to the reported event.

A fire insurance claim in Jacksonville calls for a different file: scene photographs, available fire reports, a contents inventory, cleaning or restoration proposals and payment letters. Mold, hail and plumbing losses also deserve their own cause and scope analysis. Bring temporary-repair invoices and any earlier work on the same area. The review can address additional documentation, communications with the insurer and available dispute procedures; it does not assume that a larger estimate alone establishes a covered obligation.

03

Use Jacksonville records to clarify the repair history

Jacksonville’s Building Inspection Division makes permit and inspection information available to the public, including searches by address or permit number. Request the records for the roof replacement, window work or other repair that the insurer says predates your claim. Match each record to the contractor invoice and the building area involved. A permit history can help organize what work occurred, while photographs and professional findings explain the property’s condition.

For a suspected rising-water loss, Jacksonville Development Services offers flood-zone determinations and copies of available elevation certificates. Save the determination or certificate together with the property address and any separate flood policy. These documents can make a claim review more precise, but a map designation does not prove how water reached a room. If an online record is missing or unclear, ask the responsible city department what documents it holds rather than filling gaps with assumptions about the building.

04

Condominium and HOA insurance disputes need identified owners

When seeking a Jacksonville HOA attorney or help with a condominium insurance claim, explain who is asking for representation and which property was damaged. Bring the association’s declarations, governing documents, relevant policies, inspection reports and correspondence about the repair. An association’s building claim, a unit owner’s interior claim and a dispute over maintenance may overlap factually without being the same legal matter.

For an owner facing an assessment after damage, retain the assessment notice and the board’s recorded decision, as well as the documents describing the underlying loss. Florida Statutes section 627.70132 contains a separate notice provision for qualifying condominium loss-assessment coverage; the ordinary claim deadlines should not simply be applied without that review. We can examine the disputed insurance issue and the available records before discussing a course of action. Association size or neighborhood reputation does not establish coverage or responsibility.

Florida timing rules and the Duval County court

Florida Statutes section 627.70131 generally requires a residential property insurer to acknowledge claim communications within 7 calendar days and, for claims within the payment provision’s scope, pay or deny the claim or a portion within 60 days after notice. Exceptions and tolling can change the calculation; the acknowledgment provision also limits its application once counsel represents a claimant. Preserve your submissions, delivery dates and requests for information so the actual timeline can be assessed.

Under section 627.70132, notice of an initial or reopened property claim generally must reach the insurer within 1 year of loss, and supplemental notice within 18 months. Section 95.11(2)(e) generally allows 5 years from the loss for a property-insurance contract lawsuit. These are different clocks. Older policy dates, statutory exceptions and separate flood coverage require individual review.

Section 627.70152 requires a qualifying pre-suit notice through the department at least 10 business days before filing, after the coverage determination. For a Jacksonville case properly brought in Duval County circuit court, the local circuit is the Fourth Judicial Circuit; jurisdiction and venue still need checking. Florida removed the one-way attorney-fee entitlement for property policies. Discuss fees and expenses in the representation agreement rather than assuming the insurer will pay them.

Prepare for your evaluation

Records to have ready
for your evaluation.

Start with your policy, claim number, and the insurer’s latest response. For your Jacksonville property, these additional records may help:

  • Jacksonville property address and city flood-zone determination, with any elevation certificate available from Development Services.
  • Permit and inspection records for the roof or other component involved in the disputed Duval County repair.
  • Dated Riverside, San Marco or other neighborhood property photographs showing the actual entry points and water marks, if relevant.
  • Separate homeowners, commercial or flood policies, claim numbers and every coverage or payment letter.
  • Association insurance records and assessment paperwork if the Jacksonville loss concerns shared property or a condominium unit.

Don’t delay contacting us because a record is missing. We can discuss what you have and what may be needed.

Common questions

Your Jacksonville
questions, answered.

Answers to questions about getting help with a Jacksonville property insurance claim.

Does Krapf Legal have an office in Jacksonville?

The firm serves Jacksonville from its Clearwater office at 2790 Sunset Point Road. When requesting a review, identify your Jacksonville property and the insurer handling the claim so the discussion can focus on the correct policy, loss and documents. The office location does not identify where a lawsuit must be filed.

Can a Jacksonville riverfront loss include more than a flood claim?

It can raise separate coverage questions. Jacksonville identifies several forms of flooding, and the Irma report documents river impacts. Provide evidence of both rising water and any roof or window damage. Standard homeowners coverage excludes flood, so a lawyer needs the actual policies and cause findings before assessing different portions of the loss.

Where can I find an old Jacksonville roof inspection record?

Start with the city’s public permit and inspection information, using the address or permit number. Keep the permit details and inspection result together with your contractor’s records. They can help date earlier work, but they should be considered alongside evidence of what changed during the event you reported.

What should I bring for a Jacksonville fire claim denial?

Collect the denial, full policy, fire-related reports you have, photographs and an inventory of damaged items. Add restoration proposals identifying the work still disputed. Distinguishing building repairs, contents and any claimed living expenses helps the attorney examine the particular coverage and valuation issues raised by the insurer.

Is the insurer’s 60-day period a guaranteed settlement date?

No. Section 627.70131 sets a pay-or-deny obligation for claims within its scope, with exceptions and tolling provisions. It does not require a negotiated settlement of every disagreement within 60 days. Your notice date, information requests and any dispute proceeding matter to the calculation.

How do supplemental notice and the lawsuit deadline differ?

Section 627.70132 generally gives 18 months from loss for supplemental notice, while section 95.11(2)(e) provides a five-year property-contract suit period from loss. Timely notice remains a separate requirement. Have the policy, loss date and earlier notices checked; the longer lawsuit period does not extend the reporting period.

Would a Jacksonville insurance lawsuit go to the Fourth Circuit?

Duval County belongs to the Fourth Judicial Circuit. A property dispute that meets circuit-court jurisdiction and has proper Duval venue can be filed there. Smaller claims or cases with federal jurisdiction may follow another path, so the property address alone is insufficient to choose the court.

Can I file suit immediately after a denial?

Section 627.70152 generally requires a notice of intent submitted through the department at least ten business days before a property-policy suit, after the coverage determination. Further response procedures may apply. Have counsel check applicability and timing before filing, including any approaching limitation period.

Absolutely phenomenal work and effort. They worked to help us fight our insurance company that refused to pay us what was owed, and got us a fair settlement. Hopefully I will never need a lawyer again but if I did, this is who I would call.

After our insurance company dismissed our hurricane-caused roof damage/leak claim as "age-related deterioration/wear and tear". we were referred to Krapf Legal. The Krapf Legal team were exceptional throughout the year-long battle to ensure we were compensated for our significant losses. Our attorney, Tim Delaney, was always reachable, professional and courteous - and he negotiated the exact settlement we were looking for to cover 100% of our roof replacement.

Dear family and friends, I highly recommend Mike Keeler from The Claim Squad and Geoffrey Schuessler from Krapf Legal for their exceptional service in handling my homeowner's insurance claim. Their professionalism and expertise were remarkable, especially considering the new laws that have become increasingly burdensome to homeowners since January 1st, 2023. Throughout the process, both Mr. Keeler and Mr. Schuessler demonstrated honesty and forthrightness, which I found commendable. I am grateful for their efforts in resolving my insurance claim and impressed by their dedication to their work and clients. If you need assistance with an insurance claim, I highly recommend the services of Mr. Keeler and Mr. Schuessler. Their expertise and professionalism are second to none, and I am confident that they will provide exceptional service to all. Thank you for your attention to this matter. Best regards, Taylor Taylor

In a time where we had lost hope, Keller Fisher from Krapf Legal stepped in and led us to a settlement that would allow my widowed mother in law to get the repairs that were much needed on her roof. We were denied the claim twice. We called Krapf Legal and within no time they had begun a claim with my insurance company and got it settled. Keller was professional, courteous, prompt, and available with any questions or concerns we had. I'd recommend this gentleman to anyone who is experiencing issues with their insurance company. I can't thank Keller enough for all the hard work he and his team put forth in to getting this case settled.

I had a great experience using Krapf Legal to help me settle my home insurance claim. I had provided my insurance company with everything they requested, but their offer was way less than the estimates I had to fix the damage to my house I had been waiting for almost a year for the insurance company to respond to my claim. I called Grant and he said he would take care of it, and he did! The team at Krapf legal was able to quickly settle my claim.

Our home has survived many Florida hurricanes but when a strong, surprise hail storm hit in early 2020, our house suffered substantial damage. Our homeowner’s insurance company had a team of experts on their side to fight our claim. When weeks turned into months, we knew we needed someone to represent our needs. Krapf Legal came highly recommended and we now understand why this team has earned its outstanding reputation. Every Krapf Legal representative has been so professional, understanding and so passionate about helping homeowners like us. While we live several miles away in another city, the Krapf legal team (Grant, Keller and the entire team) treated us like neighbors. They were professional, responsive and spot on with their advice. In the end, we received the compensation we needed to repair our home. Truly, we couldn’t have resolved our claim with such a positive outcome without Krapf Legal. Thank you!!!

I had extensive damage to my home from Hurricane Irma. My insurance company only stated $8k worth of damage but because my deductible was so high they sent me a check for $3k! I couldn't even get the insurance company to return my phone call for 3 months! I didn't know what to do so I hired an insurance adjuster to fight the claim. After over a 16mths of fighting it had finally gotten to the point to bring in a lawyer. They recommended Grant Krapf and I’m so glad they did! I couldn’t believe how quickly he got a response from the insurance company. In total, I had been waiting for nearly 2 years and when Grant and his team came on board it was a matter of months before they were able to get the insurance company to settle. I was shocked and amazed! I have never hired an attorney before and I had always heard unflattering stories but this was not my experience. Even after the settlement they have been kind enough to still help me with questions or advice relating to the house. They are good people and they do good work! It’s incredible when you feel like you are going up against a giant and want to give up and can find extraordinary people that will fight for you and never give up!
