Tampa storm records help frame the right insurance questions

Hurricane Helene produced a record water level at Old Port Tampa in September 2024, the National Weather Service reports. Its Milton report describes strong Hillsborough County winds and near-record daily rainfall at Tampa International Airport the following month. These observations illustrate why a Tampa claim may raise different questions about wind damage, rain entry and rising water. They do not establish which conditions occurred inside your building.

An owner searching for a flood lawyer in Tampa should bring both the flood file and any separate wind or homeowners file. Label exterior water marks, roof openings and ceiling leaks by location and date. Our review compares those observations with inspection findings and the applicable contracts. Keep estimates and payments separated by insurer so that a disagreement about one cause does not obscure unpaid work attributed to another.

A flood map and a flood-policy decision answer different questions

Tampa's Flood Protection guidance points owners to address-based FEMA and Hillsborough County mapping. It also addresses elevation certificates for applicable construction in special flood hazard areas. Use the record for the damaged property, save the map information and include any existing certificate. A location label such as Davis Islands, Historic Hyde Park or Port Tampa identifies a community; it cannot establish the water source or coverage at every address there.

A flood claim needs the policy's definition of flood, its covered property and the documented physical damage. NFIP policies are governed by federal conditions, including separate suit requirements, rather than simply borrowing Florida's homeowners deadlines. Private flood policies also need their own review. Provide every written denial, the date it was issued, the proof-of-loss documents and prior submissions. Do not wait for a homeowners dispute to finish before checking the separate flood claim's timing.

Build a roof claim around the proposed work and city records

The City of Tampa's Residential Permits page lists roofing and other repair categories for single-family residences and duplexes. It specifically directs condominium projects to commercial permitting even though the occupancy is residential. Confirm the correct project category and authority before treating a residential checklist as the applicable requirement. Keep written city instructions, permit documents already obtained and the contractor's explanation of the work.

For a denied or underpaid roof claim, compare the insurer's scope with the contractor's roof areas, quantities and repair method. Include related ceiling, insulation or wall repairs where the evidence connects them to the reported loss. Explain any previous leak and the work that resolved it. Krapf Legal can evaluate the coverage position and the supported scope difference; a municipal approval or a larger contractor total does not alone establish the insurer's payment obligation.

HOA and condominium recovery requires clear ownership of the issue

If you need a Tampa HOA attorney concerning property damage, describe the association decision or maintenance problem and provide the governing documents. For a condominium insurance dispute, section 718.111(11), Florida Statutes, addresses the association and unit-owner insurance framework. A unit's finishes, belongings and shared building components can raise separate questions. Identify which party is seeking advice and which policy or association decision remains contested.

Our attorneys can review the insurance denial or payment with the declaration, relevant correspondence and itemized estimates. If the complaint concerns board conduct rather than coverage, explain that issue separately so the potential representation is clear. For fire, smoke or suspected mold, add the relevant inspection and restoration reports. A blanket description of storm damage makes it harder to determine whether the unresolved item concerns an insurer, the association or an individual owner's scope.

Apply the Florida deadlines to the correct policy and loss date

Under Florida Statutes section 627.70131, a residential insurer generally must acknowledge claim communications within 7 calendar days, unless payment or a statutory exception makes acknowledgment unnecessary or excused. For claimants represented by a lawyer, the acknowledgment rule covers only the communications needed to provide forms and instructions (section 627.70131(1)(c), Florida Statutes). The general payment-or-denial period for an initial, reopened or supplemental claim, or a portion, is 60 days after notice, subject to the statute's coverage, exceptions and tolling rules.

Section 627.70132 generally imposes a 1-year loss-based notice limit for an initial or reopened claim and an 18-month limit for supplemental notice. A supplement involves additional loss or damage from the same peril as a previously adjusted loss, or costs incurred completing repairs or replacement under an open claim reported on time. Special condominium loss-assessment provisions can change the calculation. A policy's prompt-notice requirements also need attention.

For a Florida property-contract breach action, section 95.11(2)(e) generally measures 5 years from the loss date. That lawsuit period does not extend the earlier notice requirements. Have policy dates and any tolling checked individually. NFIP flood conditions and federal suit deadlines must be examined separately instead of applying this timetable to every Tampa water claim.

Understand the presuit process before choosing litigation

Krapf Legal starts with the insurer's written position and the records supporting your objection. A disputed estimate can concern causation, quantities, depreciation, a deductible or an exclusion, and each requires a different explanation. Bring all decisions and payment letters, including a release if one was proposed. We can discuss the additional evidence needed and the available next step without promising that a claim will be accepted or that litigation is necessary.

For suits governed by section 627.70152, a notice of intent goes through the Florida Department of Financial Services at least 10 business days before filing, after the insurer determines coverage. Statutory response procedures also apply. Hillsborough County comprises the Thirteenth Judicial Circuit; the case determines venue and whether circuit or county jurisdiction is appropriate. Our free evaluation is arranged through the Clearwater office at 2790 Sunset Point Road.

Records to have ready
for your evaluation.

Start with your policy, claim number, and the insurer’s latest response. For your Tampa property, these additional records may help:

  • Tampa or county address-based flood information, available elevation certificates and any property-specific rebuilding instructions.
  • Separate homeowners, wind and flood policies with all denial letters, proof-of-loss submissions and dates.
  • Roofing estimates identifying damaged areas and interior consequences, plus earlier roof repair and permit documents.
  • For a Tampa condo project, commercial-permit correspondence where applicable, association records and the unit owner's policy.
  • A damage timeline distinguishing Helene from Milton or another event, and itemized payments already received from each insurer.

Don’t delay contacting us because a record is missing. We can discuss what you have and what may be needed.

Common questions

Your Tampa
questions, answered.

Answers to questions about getting help with a Tampa property insurance claim.

Can your team review a disputed Tampa flood claim?

We can evaluate the policy, damage documentation and denial to determine the appropriate legal work. Identify whether the coverage is through the NFIP or a private insurer and provide every written decision. A flood review should occur alongside any separate homeowners claim, with its own deadlines checked.

Does Krapf Legal operate a Tampa office?

Tampa owners are served from our Clearwater location at 2790 Sunset Point Road, Clearwater, FL 33759. Contact that office to request a free case evaluation and discuss the records of your property insurance dispute.

Which Tampa permit guidance applies to condominium repairs?

The city's Residential Permits guidance states that a condominium requires a commercial permit despite residential occupancy. Confirm the particular project requirements with the city and retain its written response. The permit category alone does not allocate responsibility between the association, unit owner and insurer.

Will an HOA dispute automatically be part of the insurance claim?

The two matters may overlap but need separate identification. Bring the governing documents, board correspondence, relevant policies and description of the damaged component. We can assess the proposed representation once the parties and disputed decisions are clear.

What if the insurer pays for the roof but omits wet rooms?

Identify each omitted room and the evidence connecting its damage to the covered event. The restoration photographs, moisture findings and contractor's itemization can be compared with the insurer's written reasoning. A partial payment does not explain every remaining coverage or valuation issue.

Can I assume a 2024 storm claim can still be newly reported?

Usually not. For losses in September and October 2024, the ordinary 1-year initial and 18-month supplemental notice periods have passed. Existing timely claims, exceptions and applicable policy law need review. Federal flood rules require a separate calculation.

Does an underpayment establish bad faith in Tampa?

It does not establish that additional remedy by itself. Section 624.1551 requires an adverse breach adjudication and final judgment against the property insurer before the statutory extracontractual claim described there can proceed. The underlying contractual dispute and evidence must be evaluated first.

What happened to one-way attorney fees in property cases?

The 2022 legislation removed the former one-way attorney-fee entitlement for residential and commercial property policies. Earlier policy dates or a different fee basis may require analysis. Obtain an explanation of the written fee agreement and case expenses instead of assuming the insurer will pay them.

Absolutely phenomenal work and effort. They worked to help us fight our insurance company that refused to pay us what was owed, and got us a fair settlement. Hopefully I will never need a lawyer again but if I did, this is who I would call.

After our insurance company dismissed our hurricane-caused roof damage/leak claim as "age-related deterioration/wear and tear". we were referred to Krapf Legal. The Krapf Legal team were exceptional throughout the year-long battle to ensure we were compensated for our significant losses. Our attorney, Tim Delaney, was always reachable, professional and courteous - and he negotiated the exact settlement we were looking for to cover 100% of our roof replacement.

Dear family and friends, I highly recommend Mike Keeler from The Claim Squad and Geoffrey Schuessler from Krapf Legal for their exceptional service in handling my homeowner's insurance claim. Their professionalism and expertise were remarkable, especially considering the new laws that have become increasingly burdensome to homeowners since January 1st, 2023. Throughout the process, both Mr. Keeler and Mr. Schuessler demonstrated honesty and forthrightness, which I found commendable. I am grateful for their efforts in resolving my insurance claim and impressed by their dedication to their work and clients. If you need assistance with an insurance claim, I highly recommend the services of Mr. Keeler and Mr. Schuessler. Their expertise and professionalism are second to none, and I am confident that they will provide exceptional service to all. Thank you for your attention to this matter. Best regards, Taylor Taylor

In a time where we had lost hope, Keller Fisher from Krapf Legal stepped in and led us to a settlement that would allow my widowed mother in law to get the repairs that were much needed on her roof. We were denied the claim twice. We called Krapf Legal and within no time they had begun a claim with my insurance company and got it settled. Keller was professional, courteous, prompt, and available with any questions or concerns we had. I'd recommend this gentleman to anyone who is experiencing issues with their insurance company. I can't thank Keller enough for all the hard work he and his team put forth in to getting this case settled.

I had a great experience using Krapf Legal to help me settle my home insurance claim. I had provided my insurance company with everything they requested, but their offer was way less than the estimates I had to fix the damage to my house I had been waiting for almost a year for the insurance company to respond to my claim. I called Grant and he said he would take care of it, and he did! The team at Krapf legal was able to quickly settle my claim.

Our home has survived many Florida hurricanes but when a strong, surprise hail storm hit in early 2020, our house suffered substantial damage. Our homeowner’s insurance company had a team of experts on their side to fight our claim. When weeks turned into months, we knew we needed someone to represent our needs. Krapf Legal came highly recommended and we now understand why this team has earned its outstanding reputation. Every Krapf Legal representative has been so professional, understanding and so passionate about helping homeowners like us. While we live several miles away in another city, the Krapf legal team (Grant, Keller and the entire team) treated us like neighbors. They were professional, responsive and spot on with their advice. In the end, we received the compensation we needed to repair our home. Truly, we couldn’t have resolved our claim with such a positive outcome without Krapf Legal. Thank you!!!

I had extensive damage to my home from Hurricane Irma. My insurance company only stated $8k worth of damage but because my deductible was so high they sent me a check for $3k! I couldn't even get the insurance company to return my phone call for 3 months! I didn't know what to do so I hired an insurance adjuster to fight the claim. After over a 16mths of fighting it had finally gotten to the point to bring in a lawyer. They recommended Grant Krapf and I’m so glad they did! I couldn’t believe how quickly he got a response from the insurance company. In total, I had been waiting for nearly 2 years and when Grant and his team came on board it was a matter of months before they were able to get the insurance company to settle. I was shocked and amazed! I have never hired an attorney before and I had always heard unflattering stories but this was not my experience. Even after the settlement they have been kind enough to still help me with questions or advice relating to the house. They are good people and they do good work! It’s incredible when you feel like you are going up against a giant and want to give up and can find extraordinary people that will fight for you and never give up!
