Legal help with a Kissimmee hail or roof claim

If you need help with a hail claim in Kissimmee, start with the inspector's explanation of the damage. Ask for labeled photographs, the areas examined and the reasons for the recommended repairs. Krapf Legal compares those findings with the insurer's report and policy. A storm reference or a replacement proposal is useful context, but neither substitutes for evidence of damage at the insured address.

The National Weather Service's April 11, 2021 squall-line summary includes wind observations from Kissimmee and identifies hail in the Winter Park-to-Oviedo area. It does not establish hail at your Kissimmee property. Keep the claimed peril accurate and avoid treating a wind observation as a hail report. Our review can address a denial based on wear, an omitted roof area or a repair allowance that does not address the conditions documented by your contractor.

Kissimmee's Ian record shows why timing of water entry matters

Osceola County's October 3, 2022 Hurricane Ian update discussed continuing lake-level concerns affecting Kissimmee and the Oaks, and reported that Shingle Creek had reached a historic high on October 1. These historical observations show why an initial inspection and a later flood observation can describe different stages of an event. They cannot establish the cause or extent of damage to another building.

For your claim, create a sequence rather than using one description for every wet room. Note the first roof leak, when water appeared outside and whether it later crossed a doorway. Match each observation with dated photographs, mitigation records and any professional source findings. We can review the homeowners and any flood coverage separately. The old bulletin is evidence of historical conditions, not current emergency advice or a statement that a new Ian claim remains timely.

Use city drainage information as supporting evidence

Kissimmee's Stormwater and Flood Prevention guidance explains that rainfall travels through drains toward nearby lakes and that obstructions can contribute to drainage problems. Its August 2024 project announcement identified Bermuda Estates and the Lyndell Street area for drainage improvements tied to flood concerns and Ian recovery. That dated announcement does not establish the projects' present completion status or responsibility for an individual loss.

If a drainage issue coincided with damage at your home, preserve the report you made to the city and the response you received. Keep that reference separate from your insurance claim number. Record what you personally observed without assuming that a nearby blocked drain explains all interior damage. A lawyer can compare these records with the coverage denial, while a contractor or other qualified professional should explain the building's water-entry pathway.

04

A complete repair scope includes the rooms beneath the roof

An accepted roof claim can still leave a disagreement about wet insulation, drywall, cabinetry or flooring. Have the repair professional identify the damaged materials and explain the proposed work room by room. Keep drying charges separate from reconstruction and identify any amounts already paid. This lets a review address the actual scope gap instead of comparing two totals that may include different tasks.

Tell us how the Kissimmee property was used when the loss occurred: your residence, a rental, a condominium unit or a business. Provide the issued policy rather than assuming the same coverage applies to every use. If an association arranged emergency work, include its notices and available insurance correspondence. Krapf Legal can review denied, delayed or underpaid claims involving these records, including fire-related damage or mold questions where they are part of the documented loss.

The Florida deadlines run on different tracks

Section 627.70131, Florida Statutes, generally gives insurers seven calendar days to acknowledge claim communications and 60 days from notice to pay or deny a property claim or part of it. The statute has coverage-specific limits, exceptions and tolling provisions, and its acknowledgment rule is restricted for represented claimants. Retain the dates documents were received and requests were answered so a delay can be evaluated accurately.

Section 627.70132 generally requires notice of an initial or reopened claim within one year after loss and notice of a supplemental claim within 18 months after loss. These are defined categories, not interchangeable labels; special provisions may apply. A property-insurance contract action has a separate five-year period from loss under section 95.11(2)(e). Do not delay reporting because the lawsuit period appears longer.

Before a suit to which section 627.70152 applies, the insured must use the department's notice of intent process at least ten business days before filing, after a coverage determination, and follow applicable response periods. Policy dates and governing law require review. The former one-way attorney-fee entitlement was removed for property policies. Representation terms, expenses, any older-policy issue and any separate basis for fee recovery should be addressed individually.

06

Organize a Kissimmee claim for a focused consultation

The City of Kissimmee identifies a downtown district containing residential, commercial and governmental uses. Along with Bermuda Estates and the Oaks, Downtown Kissimmee is a real local community reference; none of those names establishes the policy type for a particular property. Give us the exact address, ownership details and insured use. For shared premises, identify which damaged areas are included in each estimate.

Osceola County is part of the Ninth Judicial Circuit together with Orange County. If litigation is considered, the appropriate venue, court level and any contractual process must be determined for the actual dispute. Our team works from Clearwater. To prepare a review, send the denial or payment explanation, the policy, your claim chronology and the repair evidence. Include any release, appraisal request or existing legal notice before deciding how to respond.

Prepare for your evaluation

Records to have ready
for your evaluation.

Start with your policy, claim number, and the insurer’s latest response. For your Kissimmee property, these additional records may help:

  • Kissimmee street address, insured occupancy and the policy declarations with endorsements.
  • Hail or wind inspection photographs identifying each disputed roof surface and the inspection date.
  • A multi-day water-entry chronology with any Ian-era first-notice records for an older dispute.
  • City drainage-report confirmations, especially if the observed issue involved Bermuda Estates or Lyndell Street.
  • Mitigation logs, reconstruction estimates and association correspondence grouped by damaged room or shared component.

Don’t delay contacting us because a record is missing. We can discuss what you have and what may be needed.

Common questions

Your Kissimmee
questions, answered.

Answers to questions about getting help with a Kissimmee property insurance claim.

Can your Clearwater office handle a Kissimmee insurance dispute?

Kissimmee is a service area for our Clearwater office. Tell us what was damaged and how the insurer responded so we can discuss a review and the documents needed. Representation depends on the particular matter and an agreed scope.

Does the 2021 NWS report establish hail in Kissimmee?

No. That summary describes wind observations from Kissimmee and places the reported hail farther north in the Winter Park/Maitland-to-Oviedo corridor. A Kissimmee hail claim needs evidence of the event and damage affecting the specific roof.

Why keep a city drainage reference separate from my claim number?

A report about local drainage documents a different process from notifying your insurance company. Preserve the city response as potential supporting evidence, but also use the insurer's reporting process and retain its acknowledgment of the claim.

Can water arrive after the first storm inspection?

The county's 2022 Ian update described lake-level concerns continuing after the storm. If your building's condition changed after inspection, document when and where the new water appeared and promptly provide the additional information to the appropriate insurer.

What if the damaged Kissimmee house was rented?

Supply the policy issued for that use and explain who occupied the building. Keep any claimed rental-income records with the building estimate, but treat coverage as a question for the actual contract rather than an automatic consequence of renting.

When should additional damage be reported?

Report new findings promptly and retain proof of delivery. Section 627.70132 generally allows 18 months from loss for a supplemental claim, while initial and reopened claims generally have one year. Definitions, policy dates and statutory exceptions must be checked.

Can I file suit as soon as payment is denied?

An applicable section 627.70152 notice of intent must first go through the department at least ten business days before suit, after the coverage determination. Additional response procedures can affect timing, and counsel should review which requirements govern your policy.

Does a successful claim automatically shift legal fees?

Florida's property insurance reforms removed the former one-way fee entitlement. Any older contract or other possible fee authority needs separate analysis. The fee agreement should explain how legal fees and case expenses will be handled in your matter.

Absolutely phenomenal work and effort. They worked to help us fight our insurance company that refused to pay us what was owed, and got us a fair settlement. Hopefully I will never need a lawyer again but if I did, this is who I would call.

After our insurance company dismissed our hurricane-caused roof damage/leak claim as "age-related deterioration/wear and tear". we were referred to Krapf Legal. The Krapf Legal team were exceptional throughout the year-long battle to ensure we were compensated for our significant losses. Our attorney, Tim Delaney, was always reachable, professional and courteous - and he negotiated the exact settlement we were looking for to cover 100% of our roof replacement.

Dear family and friends, I highly recommend Mike Keeler from The Claim Squad and Geoffrey Schuessler from Krapf Legal for their exceptional service in handling my homeowner's insurance claim. Their professionalism and expertise were remarkable, especially considering the new laws that have become increasingly burdensome to homeowners since January 1st, 2023. Throughout the process, both Mr. Keeler and Mr. Schuessler demonstrated honesty and forthrightness, which I found commendable. I am grateful for their efforts in resolving my insurance claim and impressed by their dedication to their work and clients. If you need assistance with an insurance claim, I highly recommend the services of Mr. Keeler and Mr. Schuessler. Their expertise and professionalism are second to none, and I am confident that they will provide exceptional service to all. Thank you for your attention to this matter. Best regards, Taylor Taylor

In a time where we had lost hope, Keller Fisher from Krapf Legal stepped in and led us to a settlement that would allow my widowed mother in law to get the repairs that were much needed on her roof. We were denied the claim twice. We called Krapf Legal and within no time they had begun a claim with my insurance company and got it settled. Keller was professional, courteous, prompt, and available with any questions or concerns we had. I'd recommend this gentleman to anyone who is experiencing issues with their insurance company. I can't thank Keller enough for all the hard work he and his team put forth in to getting this case settled.

I had a great experience using Krapf Legal to help me settle my home insurance claim. I had provided my insurance company with everything they requested, but their offer was way less than the estimates I had to fix the damage to my house I had been waiting for almost a year for the insurance company to respond to my claim. I called Grant and he said he would take care of it, and he did! The team at Krapf legal was able to quickly settle my claim.

Our home has survived many Florida hurricanes but when a strong, surprise hail storm hit in early 2020, our house suffered substantial damage. Our homeowner’s insurance company had a team of experts on their side to fight our claim. When weeks turned into months, we knew we needed someone to represent our needs. Krapf Legal came highly recommended and we now understand why this team has earned its outstanding reputation. Every Krapf Legal representative has been so professional, understanding and so passionate about helping homeowners like us. While we live several miles away in another city, the Krapf legal team (Grant, Keller and the entire team) treated us like neighbors. They were professional, responsive and spot on with their advice. In the end, we received the compensation we needed to repair our home. Truly, we couldn’t have resolved our claim with such a positive outcome without Krapf Legal. Thank you!!!

I had extensive damage to my home from Hurricane Irma. My insurance company only stated $8k worth of damage but because my deductible was so high they sent me a check for $3k! I couldn't even get the insurance company to return my phone call for 3 months! I didn't know what to do so I hired an insurance adjuster to fight the claim. After over a 16mths of fighting it had finally gotten to the point to bring in a lawyer. They recommended Grant Krapf and I’m so glad they did! I couldn’t believe how quickly he got a response from the insurance company. In total, I had been waiting for nearly 2 years and when Grant and his team came on board it was a matter of months before they were able to get the insurance company to settle. I was shocked and amazed! I have never hired an attorney before and I had always heard unflattering stories but this was not my experience. Even after the settlement they have been kind enough to still help me with questions or advice relating to the house. They are good people and they do good work! It’s incredible when you feel like you are going up against a giant and want to give up and can find extraordinary people that will fight for you and never give up!
