property damage lawyers.
A Dunedin insurance dispute may depend on whether water came off St. Joseph Sound, through a damaged roof or from a plumbing line, and on what the city requires before repairs continue. Krapf Legal reviews denied, delayed and underpaid property claims using the policy, the insurer's reasoning and the repair records. We serve Dunedin from our Clearwater office.
Explore damage & claim guidanceHelene raised the water; Milton brought gusts and heavy rain
The National Hurricane Center's Helene report places peak storm surge inundation of 5 to 7 feet above ground from the Anclote River south to Longboat Key, a stretch that takes in Dunedin's St. Joseph Sound shoreline. The NOAA tide gauge at Clearwater Beach reached 6.67 feet above mean higher high water, a record for that station. Milton arrived in October 2024 with a different profile. The center's Milton report lists a weather station on the Dunedin Causeway with a peak gust of 64 knots, and an observer 2.8 miles east-southeast of Dunedin measured 11.66 inches of rain. The National Weather Service describes Milton's coastal Pinellas water levels as generally a foot or less above that tidal benchmark, with a period of blowout tide.
Those readings describe the area, not your building. For a waterfront or low-lying Dunedin home, an insurer may treat lower-wall damage as flood, which a homeowners policy does not cover, and question whether a later roof leak came from Milton or from wear. Keep separate folders for each storm showing water lines, roof openings, emergency work and anything repaired between September and October. Our attorneys use that sequence to test a denial that assigns every wet surface to an excluded or earlier cause.
Hurricane damage claim reviewDunedin's 50 percent review is not the insurer's estimate
Dunedin's Substantial Improvement/Damage Review packet, revised in April 2025, applies the FEMA 50 percent rule when a building's lowest floor or its electrical, plumbing and mechanical equipment sits below the current base flood elevation. The city starts from the structure's tax-assessed value, excluding land, and accepts a certified appraisal from an owner who disagrees. It requires a complete repair estimate signed by a licensed contractor, with an affidavit that the estimate covers all damage, and it prices repairs at pre-storm rates.
The city's calculation leaves out debris removal, clean-up and building dry-out, furniture and freestanding appliances, and outside items such as fences, pools, screened enclosures and detached garages. An insurance claim may treat some of those items under separate coverages or limits, so the two totals rarely match and neither proves the other. If the city finds substantial damage, the packet requires elevation to 1 foot above base flood elevation or to the design flood elevation, whichever is higher. A federal flood policy with building coverage includes Increased Cost of Compliance coverage of up to $30,000, subject to its terms.
Property damage attorney services Water damage insurance disputesUse the Dunedin permit file, including repairs already finished
Dunedin's storm-recovery guidance for residential buildings directs owners to apply through the city's CSS portal under the Alteration to Residential Building permit type, and it says storm repair permits receive priority review. The application can call for a recorded notice of commencement, a subcontractor list, an asbestos advisory form and a basic floor plan, which may be drawn from the building layout on the Pinellas County Property Appraiser's website. For buildings subject to the 50 percent review, the city says even cabinets, floor coverings and fixtures must be permitted and counted.
In June 2026, the city reported that most flood-damaged structures had received repair permits and said it would mail notices to owners still lacking them, allowing an additional 60 days, including for repairs completed without permits. If you received that notice, keep it with the permit application, the contractor's invoices and photographs taken before walls were closed. An insurer reviewing a reopened or supplemental request may ask what was repaired and when. The permit record helps answer that question, though payment still depends on the policy.
Roof damage insurance claimsWaterfront condominiums: divide the building, the unit and the flood policy
Section 718.111(11)(f), Florida Statutes, requires a condominium association's policy to cover condominium property as originally installed or replaced with like kind and quality. It excludes items within a unit that serve only that unit, such as floor, wall and ceiling coverings, electrical fixtures, appliances, water heaters, built-in cabinets, countertops and window treatments, and makes those items and their insurance the unit owner's responsibility. For a Dunedin condo damaged by water, list each item under the policy that should respond to it.
Rising water adds another layer. The city's Flood Awareness page reminds residents that homeowners policies do not cover flood losses, and a federal flood policy has its own proof-of-loss and lawsuit rules. Keep the association's adjuster report, any association flood-policy information you can obtain, your unit policy and your own flood policy in separate files. Krapf Legal can review the decision affecting your unit and identify which disagreement belongs with which insurer or with the association.

Under section 627.70131, a residential property insurer generally must acknowledge a claim communication within 7 calendar days, conduct any physical inspection within 30 days after receiving proof-of-loss statements, and send the policyholder any detailed estimate within 7 days after its adjuster generates it. It generally must pay or deny an initial, reopened or supplemental claim, or part of one, within 60 days after notice, subject to the statute's exceptions. The acknowledgment duty does not apply to claimants represented by counsel beyond communications needed to provide forms and instructions.
Section 627.70132 generally bars an initial or reopened claim not noticed within 1 year after the date of loss and a supplemental claim not noticed within 18 months; for a hurricane, the date of loss is the landfall date. Section 95.11(2)(e) allows 5 years from the date of loss to sue for breach of a property insurance contract. A flood policy is different: the standard federal form requires suit within one year after the written denial, in federal district court.
Starting a review with our Clearwater team
Bring the denial or payment letter, the estimate behind it, the policy and every Dunedin permit or 50 percent review document tied to the repair. We examine the provisions the insurer relied on and the evidence still missing, then discuss whether further documentation, negotiation or litigation fits the dispute. A free case evaluation covers the file and proposed fee terms; it does not predict a result.
Where section 627.70152 applies, a suit must be preceded by a notice of intent filed through the Florida Department of Financial Services at least 10 business days in advance, and only after the insurer's coverage determination. After a denial, the notice includes an estimate of damages if known; otherwise it carries an itemized presuit settlement demand. The insurer then has 10 business days to respond in writing, which can involve reinspection, a settlement offer, or appraisal or another dispute resolution method. Pinellas County cases fall within the Sixth Judicial Circuit, and our office is at 2790 Sunset Point Road in Clearwater.

Records to have ready
for your evaluation.
Start with your policy, claim number, and the insurer’s latest response. For your Dunedin property, these additional records may help:
- The Dunedin Substantial Improvement/Damage Review forms, the contractor's affidavit and any appraisal submitted for the structure.
- Permit applications, any city notice about missing repair permits, and invoices for work finished before a permit was issued.
- An elevation certificate or elevation survey showing the lowest floor elevation, plus the city flood-zone result for the address.
- Separate Helene and Milton photo sets showing water lines, roof openings and the date of each emergency repair.
- Homeowners, condominium and flood policies, each insurer's decision letter and proof of when every claim notice was sent.
Don’t delay contacting us because a record is missing. We can discuss what you have and what may be needed.
Common questions
Your Dunedin
questions, answered.
Answers to questions about getting help with a Dunedin property insurance claim.
Is there a Krapf Legal office in Dunedin?
No. Dunedin owners are served from our office at 2790 Sunset Point Road, Clearwater, FL 33759. Contact the team there to arrange a free case evaluation and to learn which claim documents to send first.
Does a Dunedin substantial-damage finding mean my insurer must pay to elevate the house?
Not automatically. The city's review applies floodplain rules; what an insurer owes depends on the policy. A federal flood policy with building coverage may provide Increased Cost of Compliance coverage of up to $30,000, and a homeowners policy should be checked for any code-related coverage.
Why is the city's repair figure different from my insurance estimate?
Dunedin's 50 percent calculation uses pre-storm prices and excludes items such as debris removal, dry-out, furniture and outside improvements. An insurer's estimate follows the policy's coverages and limits. Compare the two line by line instead of treating either total as proof.
I received a city notice about missing permits. Does that affect my claim?
It may affect the repair schedule and what the insurer asks about completed work. Keep the notice, the permit application and invoices together. The city's notice concerns permitting compliance; it is not a decision about insurance coverage.
Will Dunedin's flood insurance discount help after a loss?
The city says its Class 5 Community Rating System standing provides a 25 percent reduction in flood insurance premiums. That affects what coverage costs, not whether a particular flood claim is paid. A claim dispute turns on the flood policy's terms and the evidence.
Can I still file a first claim for Helene or Milton damage?
For losses from those 2024 hurricanes, the ordinary 1-year period for an initial claim and 18-month period for a supplemental claim, measured from landfall, have passed. A timely existing claim, a flood policy or a statutory exception may raise different issues, so have the dates reviewed individually.
Is a slow or low payment proof that my insurer acted in bad faith?
No. Section 624.1551 requires a court ruling that the property insurer breached the policy and a final judgment against it before the statutory bad-faith action may proceed. Paying an appraisal award does not count as that ruling.
Will the insurer pay my attorney fees if the claim succeeds?
Do not assume so. Florida's 2022 reforms removed the former one-way fee entitlement for residential and commercial property policies, and policy dates can matter. Review the written fee agreement and expected costs before engaging counsel.

See all reviews on GoogleThis firm was professional, responsive and handled my situation well. I also feel their billing was reasonable. Robert Studor and his staff were great to work with.
Absolutely phenomenal work and effort. They worked to help us fight our insurance company that refused to pay us what was owed, and got us a fair settlement. Hopefully I will never need a lawyer again but if I did, this is who I would call.
Robert was attentive and updated us along the route. Any questions I texted were answered quickly. We’re ver satisfied.
I luckily chose Keller Fisher of Krapf Legal for my roof damage claim. He was smart, responsive and knew what needed to be done. I would highly suggest working with Keller.

A very well run law firm if you have a gripe with your homeowners insurance.
After our insurance company dismissed our hurricane-caused roof damage/leak claim as "age-related deterioration/wear and tear". we were referred to Krapf Legal. The Krapf Legal team were exceptional throughout the year-long battle to ensure we were compensated for our significant losses. Our attorney, Tim Delaney, was always reachable, professional and courteous - and he negotiated the exact settlement we were looking for to cover 100% of our roof replacement.
Dear family and friends, I highly recommend Mike Keeler from The Claim Squad and Geoffrey Schuessler from Krapf Legal for their exceptional service in handling my homeowner's insurance claim. Their professionalism and expertise were remarkable, especially considering the new laws that have become increasingly burdensome to homeowners since January 1st, 2023. Throughout the process, both Mr. Keeler and Mr. Schuessler demonstrated honesty and forthrightness, which I found commendable. I am grateful for their efforts in resolving my insurance claim and impressed by their dedication to their work and clients. If you need assistance with an insurance claim, I highly recommend the services of Mr. Keeler and Mr. Schuessler. Their expertise and professionalism are second to none, and I am confident that they will provide exceptional service to all. Thank you for your attention to this matter. Best regards, Taylor Taylor
In a time where we had lost hope, Keller Fisher from Krapf Legal stepped in and led us to a settlement that would allow my widowed mother in law to get the repairs that were much needed on her roof. We were denied the claim twice. We called Krapf Legal and within no time they had begun a claim with my insurance company and got it settled. Keller was professional, courteous, prompt, and available with any questions or concerns we had. I'd recommend this gentleman to anyone who is experiencing issues with their insurance company. I can't thank Keller enough for all the hard work he and his team put forth in to getting this case settled.

I had a great experience using Krapf Legal to help me settle my home insurance claim. I had provided my insurance company with everything they requested, but their offer was way less than the estimates I had to fix the damage to my house I had been waiting for almost a year for the insurance company to respond to my claim. I called Grant and he said he would take care of it, and he did! The team at Krapf legal was able to quickly settle my claim.

Our home has survived many Florida hurricanes but when a strong, surprise hail storm hit in early 2020, our house suffered substantial damage. Our homeowner’s insurance company had a team of experts on their side to fight our claim. When weeks turned into months, we knew we needed someone to represent our needs. Krapf Legal came highly recommended and we now understand why this team has earned its outstanding reputation. Every Krapf Legal representative has been so professional, understanding and so passionate about helping homeowners like us. While we live several miles away in another city, the Krapf legal team (Grant, Keller and the entire team) treated us like neighbors. They were professional, responsive and spot on with their advice. In the end, we received the compensation we needed to repair our home. Truly, we couldn’t have resolved our claim with such a positive outcome without Krapf Legal. Thank you!!!
Seriously the best property insurance attorney there is. Highly recommend!

Excellent company with superb customer service!
The team at Krapf Legal is a group of dedicated professionals that bring significant contribution and value to their clients. They are highly responsive, communicate expectations effectively and more importantly, get timely results for the folks that they represent. I highly recommend this firm, whether working with them directly or through a public adjuster.
I had extensive damage to my home from Hurricane Irma. My insurance company only stated $8k worth of damage but because my deductible was so high they sent me a check for $3k! I couldn't even get the insurance company to return my phone call for 3 months! I didn't know what to do so I hired an insurance adjuster to fight the claim. After over a 16mths of fighting it had finally gotten to the point to bring in a lawyer. They recommended Grant Krapf and I’m so glad they did! I couldn’t believe how quickly he got a response from the insurance company. In total, I had been waiting for nearly 2 years and when Grant and his team came on board it was a matter of months before they were able to get the insurance company to settle. I was shocked and amazed! I have never hired an attorney before and I had always heard unflattering stories but this was not my experience. Even after the settlement they have been kind enough to still help me with questions or advice relating to the house. They are good people and they do good work! It’s incredible when you feel like you are going up against a giant and want to give up and can find extraordinary people that will fight for you and never give up!
Highly recommend Krapf Legal. Cailtin has always greeted us in a friendly and professional manner and made us feel like a very important client. Grant and his staff were always prompt to address our needs and timely respond to any questions. Very knowledgable, respectful, reliable, courteous and professional.
Grant and his team consistently achieve great results for their clients. They are people you can trust and always act in their client’s best interest.
