01

Coastal surge and inland ponding both reach Oldsmar

The City of Oldsmar describes itself as adjacent to Tampa Bay and susceptible to both coastal and inland flooding. Inland flooding, the city explains, happens when lakes rise above normal levels or rain fills low depressions and forms ponds, and paved surfaces leave heavy rain with nowhere to drain. During Helene, the National Weather Service recorded peak water levels generally 4 to 7 feet above mean higher high water along coastal Pinellas. During Milton, the National Hurricane Center lists 13.68 inches of rain at an Oldsmar gauge, while Pinellas coastal water levels generally stayed a foot or less above that datum.

That combination matters because homeowners policies treat flood differently from other water. The Department of Financial Services explains that flood is not covered by a homeowners policy and that the usual flood definition includes runoff of surface water, while Oldsmar notes that flood insurance covers losses from surface flooding and local drainage problems. Water that rose across a yard and under a door raises different coverage questions than rain driven through a damaged roof or window. Describe the entry point and timing as precisely as the evidence allows.

How Oldsmar measures substantial damage

Oldsmar uses a 49 percent threshold. Damage is substantial when restoring the building to its pre-damage condition would cost 49 percent or more of the structure's market value, and that cost must include all labor. Substantial improvement is measured cumulatively over a five-year period that starts with the first improvement or repair permit issued after February 19, 2013, and the city does not allow work to be phased to stay under the line. Market value excludes the land and is based either on an actual cash value appraisal by a qualified independent appraiser or on the Property Appraiser's just value, adjusted to approximate market value.

Some costs are excluded, including minimum corrections of identified code violations and certain alterations of historic structures. Code-compliant wind and flood mitigation, such as storm shutters, impact windows, stronger roof attachments and flood openings, and certain energy-efficiency retrofits are also excluded, but only if their cost plus other work done at the same time stays below 49 percent. If a remodel in the last five years counts toward the total, bring those permits and invoices with the storm estimate. Your insurer's depreciated figures and the appraisal used for the city serve different purposes, so keep both and label them.

Oldsmar's post-storm permit file is also claim evidence

The city's Post-Storm Permitting Guide asks owners repairing hurricane damage for a detailed cost breakdown of all materials and labor, including drywall, flooring, painting and other cosmetic work. Pre-FIRM homes, which the city describes as those built before flood maps were in place in the late 1970s, and properties placed in the county's major-damage category need a substantial damage inspection before a permit issues; county building staff perform those inspections in Oldsmar as building official. Limited demolition, such as removing damaged drywall, is allowed before a permit, but unpermitted repairs may have to be reworked or removed.

That cost breakdown is, in substance, a repair estimate, and the insurer may see it. Prepare it once, carefully, and explain any difference from the insurer's estimate in writing. If the inspection leads to elevation or other compliance work, look at the homeowners policy's law and ordinance coverage, which section 627.7011 deems included at 25 percent of the dwelling limit unless the owner rejected it in writing. Families living in a private RV during repairs need a city temporary housing permit; keep those costs with any additional living expense request.

Records to pull for an Oldsmar address

Oldsmar uses the Forerunner platform to give each property a public profile showing its flood zone, base flood elevation, design flood elevation, compliance warnings and available documents, including elevation certificates and prior substantial improvement or damage history. The city's flood insurance page adds that it holds elevation certificates for buildings constructed in the floodplain since 1995 but not for every property. FEMA's CRS community list effective October 2026 shows Oldsmar at Class 5, a 25 percent flood premium discount in the Special Flood Hazard Area; that discount has no effect on whether a loss is covered.

Manufactured homes need their own policy review. Oldsmar notes that the National Flood Insurance Program insures buildings including mobile homes, and the Department of Financial Services explains that insurers may cover a mobile home under a dwelling form or an HO-7 form, with different coverages. Pinellas evacuations covered all mobile home parks during Helene and all mobile homes during Milton. Bring the declarations page and full form for every policy on the home, along with photographs of tie-downs, skirting and the underside if they were damaged.

05

Florida deadlines and estimate rules for Oldsmar claims

Section 627.70132, Florida Statutes, generally requires notice of an initial or reopened claim within 1 year after the date of loss and of a supplemental claim within 18 months. For a hurricane, the date of loss is the landfall date. A supplemental claim seeks additional loss from the same peril the insurer already adjusted, or costs incurred while completing repairs under an open, timely reported claim.

Section 627.70131 contains estimate rules that matter in a valuation dispute. The insurer must send a copy of any detailed estimate within 7 days after its adjuster generates it, and a preliminary or partial estimate must carry a printed statement that it may be revised. Subject to exceptions and tolling, the insurer generally must pay or deny within 60 days after notice and explain its decision in writing, including the reason when it pays less than its own detailed estimate.

A suit for breach of a property insurance contract generally must be filed within 5 years from the date of loss under section 95.11(2)(e). For a federal flood policy, the policyholder generally must send a signed proof of loss within 60 days after the loss and sue in federal court within one year after a written denial.

Starting a review with Krapf Legal in Clearwater

Bring the decision or payment letter, the full policy, every estimate and the Oldsmar records tied to the property: the cost breakdown filed with the city, any substantial damage letter, the Forerunner profile and the elevation certificate. Our attorneys compare the insurer's stated reasons with that evidence and the policy language. The free case evaluation covers the file and possible representation terms and does not predict a recovery.

Where section 627.70152 applies, the policyholder must file a notice of intent to sue through the Florida Department of Financial Services at least 10 business days before filing suit, and only after the insurer's coverage determination. Pinellas cases belong to the Sixth Judicial Circuit, though the right court depends on the claim. Krapf Legal's single physical office is at 2790 Sunset Point Road in Clearwater, and Oldsmar owners are served from that office.

Common questions

Your Oldsmar
questions, answered.

Answers to questions about getting help with a Oldsmar property insurance claim.

Is there a Krapf Legal office in Oldsmar?

No. Krapf Legal has one physical office, at 2790 Sunset Point Road, Clearwater, FL 33759, and serves Oldsmar owners from there. Contact the office to set up a free case evaluation and to arrange how your records will be shared.

Rainwater ponded in my yard during Milton and came under the door. Is that a homeowners claim?

Possibly not. Homeowners policies generally exclude flood, and the usual definition includes surface-water runoff. A flood policy may respond instead. If wind also opened the roof or windows, that damage needs separate documentation under the homeowners policy.

Does the city's substantial-damage decision determine what my insurer owes?

No. The city's decision governs how the building may be repaired; payment depends on the policy and the evidence of loss. The decision can still matter, for example when elevation work raises questions about law and ordinance coverage.

Why does a kitchen remodel from a few years ago affect my storm repairs?

Oldsmar measures substantial improvement cumulatively over a five-year period, so earlier permitted work can count toward the 49 percent threshold together with storm repairs. Bring those permits and invoices so the calculation can be checked.

Can I remove wet drywall before I get a permit?

The city allows limited demolition, such as removing damaged drywall, before a permit. Photograph and measure the damage first, keep samples where practical and tell the insurer what was removed, so the condition can still be evaluated.

My insurer sent a preliminary estimate. Is it final?

Florida law requires a preliminary or partial estimate to state that it may be revised. Ask for a copy of any detailed estimate and the written explanation of each payment, then compare them with your contractor's scope.

Can I still open a new claim for Helene or Milton damage?

For these 2024 hurricanes, the ordinary 1-year notice period for an initial claim and the 18-month period for a supplemental claim, both counted from landfall, have already passed. Existing claims, exceptions and flood policies require individual review.

Does winning mean the insurer pays my lawyer?

Not automatically. The 2022 reforms ended the former one-way attorney-fee entitlement for residential and commercial property policies; older policies and other fee rules may need review. Discuss the written fee agreement and expenses before deciding.

After our insurance company dismissed our hurricane-caused roof damage/leak claim as "age-related deterioration/wear and tear". we were referred to Krapf Legal. The Krapf Legal team were exceptional throughout the year-long battle to ensure we were compensated for our significant losses. Our attorney, Tim Delaney, was always reachable, professional and courteous - and he negotiated the exact settlement we were looking for to cover 100% of our roof replacement.

Dear family and friends, I highly recommend Mike Keeler from The Claim Squad and Geoffrey Schuessler from Krapf Legal for their exceptional service in handling my homeowner's insurance claim. Their professionalism and expertise were remarkable, especially considering the new laws that have become increasingly burdensome to homeowners since January 1st, 2023. Throughout the process, both Mr. Keeler and Mr. Schuessler demonstrated honesty and forthrightness, which I found commendable. I am grateful for their efforts in resolving my insurance claim and impressed by their dedication to their work and clients. If you need assistance with an insurance claim, I highly recommend the services of Mr. Keeler and Mr. Schuessler. Their expertise and professionalism are second to none, and I am confident that they will provide exceptional service to all. Thank you for your attention to this matter. Best regards, Taylor Taylor

In a time where we had lost hope, Keller Fisher from Krapf Legal stepped in and led us to a settlement that would allow my widowed mother in law to get the repairs that were much needed on her roof. We were denied the claim twice. We called Krapf Legal and within no time they had begun a claim with my insurance company and got it settled. Keller was professional, courteous, prompt, and available with any questions or concerns we had. I'd recommend this gentleman to anyone who is experiencing issues with their insurance company. I can't thank Keller enough for all the hard work he and his team put forth in to getting this case settled.

I had a great experience using Krapf Legal to help me settle my home insurance claim. I had provided my insurance company with everything they requested, but their offer was way less than the estimates I had to fix the damage to my house I had been waiting for almost a year for the insurance company to respond to my claim. I called Grant and he said he would take care of it, and he did! The team at Krapf legal was able to quickly settle my claim.

Our home has survived many Florida hurricanes but when a strong, surprise hail storm hit in early 2020, our house suffered substantial damage. Our homeowner’s insurance company had a team of experts on their side to fight our claim. When weeks turned into months, we knew we needed someone to represent our needs. Krapf Legal came highly recommended and we now understand why this team has earned its outstanding reputation. Every Krapf Legal representative has been so professional, understanding and so passionate about helping homeowners like us. While we live several miles away in another city, the Krapf legal team (Grant, Keller and the entire team) treated us like neighbors. They were professional, responsive and spot on with their advice. In the end, we received the compensation we needed to repair our home. Truly, we couldn’t have resolved our claim with such a positive outcome without Krapf Legal. Thank you!!!

I had extensive damage to my home from Hurricane Irma. My insurance company only stated $8k worth of damage but because my deductible was so high they sent me a check for $3k! I couldn't even get the insurance company to return my phone call for 3 months! I didn't know what to do so I hired an insurance adjuster to fight the claim. After over a 16mths of fighting it had finally gotten to the point to bring in a lawyer. They recommended Grant Krapf and I’m so glad they did! I couldn’t believe how quickly he got a response from the insurance company. In total, I had been waiting for nearly 2 years and when Grant and his team came on board it was a matter of months before they were able to get the insurance company to settle. I was shocked and amazed! I have never hired an attorney before and I had always heard unflattering stories but this was not my experience. Even after the settlement they have been kind enough to still help me with questions or advice relating to the house. They are good people and they do good work! It’s incredible when you feel like you are going up against a giant and want to give up and can find extraordinary people that will fight for you and never give up!
