Palm Harbor
property damage lawyers.

Palm Harbor has no city hall. As an unincorporated community, its building permits, elevation records and substantial-damage decisions run through Pinellas County government. Krapf Legal reviews denied, delayed and underpaid property insurance claims against those county records and the policy itself. We serve Palm Harbor from our Clearwater office.

Pinellas County keeps the records for Palm Harbor properties

Pinellas County lists 24 municipalities, and Palm Harbor is not among them. The county defines unincorporated property as land outside city limits, provides services to those residents, and has the Board of County Commissioners serve as their local government. Its North County community coordinator works from Harbor Hall on Georgia Avenue and covers East Lake, Palm Harbor, Highland Lakes, Crystal Beach, Ozona and Greenbriar.

For an insurance dispute, that means the roof permit history, inspection results and storm-repair applications for a Palm Harbor address sit with the county's Building and Development Review Services Department. It handles permits and inspections for unincorporated Pinellas and a small number of partner communities through its Access Portal. Request records for the specific parcel rather than relying on a neighborhood summary. If an insurer calls a roof too old or a repair unpermitted, the county file and your contractor's invoices are where that position gets tested.

02

How the county's 49 percent rule applies to Palm Harbor homes

For unincorporated areas, Pinellas County treats a home as substantially damaged when the repair cost is 49 percent or more of the structure's value without the land; such a home must be elevated or rebuilt to current floodplain codes. The county counts materials and labor, including donated materials and owner or volunteer labor, along with demolition and debris disposal, contractor overhead and profit, utility equipment, elevation or floodproofing, site preparation and code-compliance costs. The value can come from the Property Appraiser's just value for the structure or from an independent actual cash value appraisal.

The county's online lookup shows only determinations that have been mailed. An owner who disagrees can ask the Property Appraiser for a pre-storm building value reconsideration, obtain an appraisal that follows county guidelines, or submit damage photographs, and then file a reassessment application. None of that decides what an insurer owes. The county tells residents to file claims with their insurers and points flood policyholders to Increased Cost of Compliance coverage, which the federal policy caps at $30,000.

North Pinellas readings from Helene and Milton

The National Weather Service reported Helene's highest Pinellas rainfall total, 4.38 inches, near Crystal Beach, while peak water levels along the county's coast generally ran 4 to 7 feet above mean higher high water. The National Hurricane Center's report adds a USGS sensor reading of 7.23 feet above that benchmark at Fred Howard Park on the north Pinellas coast, with significant waves on top, and notes that survey crews found stilled waterlines inside many homes along this part of the coast.

Milton reversed the pattern about two weeks later. Coastal Pinellas water stayed around a foot or less above the benchmark, with a period of blowout tide, but the hurricane center's Milton report lists 12.52 inches of rain at a Palm Harbor gauge, 12.65 inches from an observer southeast of Palm Harbor and 13.05 inches at Curlew Creek.

A Palm Harbor home could therefore show a surge line from September and a ceiling stain from October. Photograph each, keep each insurer's claim number and note what was repaired between the storms. Homeowners policies exclude flood, while a federal flood policy has its own conditions; blending the two events into one description invites a denial based on cause.

Elevation certificates and flood records for unincorporated parcels

Pinellas County provides copies of FEMA elevation certificates for buildings in the unincorporated area constructed in the floodplain since 1992, viewable through its Elevation Certificate Map. It does not hold certificates for older buildings or for certificates completed only for flood insurance purposes. A certificate is prepared by a licensed surveyor and records the flood zone, the flood elevation and details about the building and surrounding ground. County Flood Information Services can be reached at 727-464-7700.

The county reports a Class 2 Community Rating System rating for unincorporated Pinellas, with a 40 percent discount on NFIP flood insurance premiums. That rating lowers premium cost; it does not decide whether a specific flood claim is payable. In a dispute, the certificate helps show how the building sits relative to the mapped flood elevation, which supports a clearer account of where water entered and how high it rose.

05

Manufactured homes, HOAs and condominiums around Palm Harbor

Pinellas evacuation orders reached all mobile home parks during Helene and all mobile homes during Milton, according to the National Weather Service. If you own a manufactured home, confirm which policy form insures it; the Florida Department of Financial Services notes that many insurers stopped selling mobile home policies that duplicate homeowners coverage. Photograph the roof, skirting, attachments and interior separately, because carports, sheds and screen rooms may fall under different parts of a policy than the home itself.

For a Palm Harbor condominium, section 718.111(11) places the building as originally installed on the association's policy, while the unit owner insures interior finishes, fixtures and appliances serving only that unit. If the association levies an assessment after a covered loss, section 627.70132 allows loss-assessment notice by the later of 1 year after the loss or 90 days after the board votes on the assessment, but no later than 3 years after the loss. An HOA dispute should start with the governing documents and the specific association action at issue.

Deadlines, presuit notice and a Clearwater consultation

Section 627.70131 generally requires a residential insurer to acknowledge claim communications within 7 calendar days and to pay or deny an initial, reopened or supplemental claim, in whole or in part, within 60 days after notice, subject to exceptions; the acknowledgment rule does not reach represented claimants beyond forms and instructions. Section 627.70132 sets 1 year from the date of loss for initial or reopened claim notice and 18 months for supplemental notice, and section 95.11(2)(e) sets 5 years from the date of loss to sue on the policy.

Before a suit under a residential or commercial property policy, section 627.70152 requires a notice of intent through the Department of Financial Services at least 10 business days before filing and after the coverage determination; the insurer must answer in writing within 10 business days. Palm Harbor cases fall in the Sixth Judicial Circuit. • The county substantial-damage letter from the online lookup, if one was mailed, plus any reassessment application and appraisal.
  • Pinellas County permit and inspection records for the roof or repair the insurer disputes, obtained through the Access Portal or the building department.
  • The county elevation certificate for a floodplain building built since 1992, or a surveyor's certificate for an older home.
  • Dated Helene water-line photos kept apart from Milton roof and ceiling photos, with invoices for any work done between the storms.
  • Each homeowners, manufactured-home, condominium or flood policy with its decision letter, plus any association assessment notice.

Don’t delay contacting us because a record is missing. We can discuss what you have and what may be needed.

Common questions

Your Palm Harbor
questions, answered.

Answers to questions about getting help with a Palm Harbor property insurance claim.

Does Krapf Legal have a Palm Harbor office?

No. Palm Harbor clients are served from our only office, 2790 Sunset Point Road, Clearwater, FL 33759. Contact the team to schedule a free case evaluation and ask which records to gather first.

Should I contact a city or the county about a Palm Harbor permit?

Palm Harbor is unincorporated, so Pinellas County provides building permits, inspections and flood information there. Confirm your parcel's jurisdiction first, because nearby addresses inside a city follow that city's process instead.

What if the county's substantial-damage value seems too low?

The county allows a pre-storm value reconsideration through the Property Appraiser, an appraisal meeting its guidelines or supporting photographs, followed by a reassessment application. Keep that process separate from your insurance claim, which depends on the policy.

Does a county substantial-damage letter make my insurer pay to elevate?

Not by itself. A federal flood policy with building coverage includes Increased Cost of Compliance coverage of up to $30,000 under its terms, and a homeowners policy needs separate review. Bring the letter, both policies and the contractor's scope.

Does the county's flood insurance discount affect a claim?

The county reports a 40 percent NFIP premium discount for unincorporated areas under its Class 2 rating. That changes what coverage costs. Whether a flood loss is paid depends on the flood policy, its proof-of-loss rules and the evidence.

Can I still report new damage from the 2024 storms?

For Helene and Milton losses, the ordinary 1-year initial and 18-month supplemental notice periods, measured from landfall, have run. Timely existing claims, condominium loss-assessment timing and flood policies raise separate questions that need individual review.

My insurer paid but never sent its adjuster's estimate. What can I ask for?

Section 627.70131 generally requires the insurer to send a copy of any detailed estimate within 7 days after its adjuster generates it. Request that estimate in writing and keep it beside your contractor's scope for a line-by-line comparison.

Does a denial alone support a bad-faith lawsuit?

No. Section 624.1551 requires an adverse adjudication that the property insurer breached the policy and a final judgment before the statutory bad-faith action may proceed. The underlying coverage dispute comes first.

Absolutely phenomenal work and effort. They worked to help us fight our insurance company that refused to pay us what was owed, and got us a fair settlement. Hopefully I will never need a lawyer again but if I did, this is who I would call.

After our insurance company dismissed our hurricane-caused roof damage/leak claim as "age-related deterioration/wear and tear". we were referred to Krapf Legal. The Krapf Legal team were exceptional throughout the year-long battle to ensure we were compensated for our significant losses. Our attorney, Tim Delaney, was always reachable, professional and courteous - and he negotiated the exact settlement we were looking for to cover 100% of our roof replacement.

Dear family and friends, I highly recommend Mike Keeler from The Claim Squad and Geoffrey Schuessler from Krapf Legal for their exceptional service in handling my homeowner's insurance claim. Their professionalism and expertise were remarkable, especially considering the new laws that have become increasingly burdensome to homeowners since January 1st, 2023. Throughout the process, both Mr. Keeler and Mr. Schuessler demonstrated honesty and forthrightness, which I found commendable. I am grateful for their efforts in resolving my insurance claim and impressed by their dedication to their work and clients. If you need assistance with an insurance claim, I highly recommend the services of Mr. Keeler and Mr. Schuessler. Their expertise and professionalism are second to none, and I am confident that they will provide exceptional service to all. Thank you for your attention to this matter. Best regards, Taylor Taylor

In a time where we had lost hope, Keller Fisher from Krapf Legal stepped in and led us to a settlement that would allow my widowed mother in law to get the repairs that were much needed on her roof. We were denied the claim twice. We called Krapf Legal and within no time they had begun a claim with my insurance company and got it settled. Keller was professional, courteous, prompt, and available with any questions or concerns we had. I'd recommend this gentleman to anyone who is experiencing issues with their insurance company. I can't thank Keller enough for all the hard work he and his team put forth in to getting this case settled.

I had a great experience using Krapf Legal to help me settle my home insurance claim. I had provided my insurance company with everything they requested, but their offer was way less than the estimates I had to fix the damage to my house I had been waiting for almost a year for the insurance company to respond to my claim. I called Grant and he said he would take care of it, and he did! The team at Krapf legal was able to quickly settle my claim.

Our home has survived many Florida hurricanes but when a strong, surprise hail storm hit in early 2020, our house suffered substantial damage. Our homeowner’s insurance company had a team of experts on their side to fight our claim. When weeks turned into months, we knew we needed someone to represent our needs. Krapf Legal came highly recommended and we now understand why this team has earned its outstanding reputation. Every Krapf Legal representative has been so professional, understanding and so passionate about helping homeowners like us. While we live several miles away in another city, the Krapf legal team (Grant, Keller and the entire team) treated us like neighbors. They were professional, responsive and spot on with their advice. In the end, we received the compensation we needed to repair our home. Truly, we couldn’t have resolved our claim with such a positive outcome without Krapf Legal. Thank you!!!

I had extensive damage to my home from Hurricane Irma. My insurance company only stated $8k worth of damage but because my deductible was so high they sent me a check for $3k! I couldn't even get the insurance company to return my phone call for 3 months! I didn't know what to do so I hired an insurance adjuster to fight the claim. After over a 16mths of fighting it had finally gotten to the point to bring in a lawyer. They recommended Grant Krapf and I’m so glad they did! I couldn’t believe how quickly he got a response from the insurance company. In total, I had been waiting for nearly 2 years and when Grant and his team came on board it was a matter of months before they were able to get the insurance company to settle. I was shocked and amazed! I have never hired an attorney before and I had always heard unflattering stories but this was not my experience. Even after the settlement they have been kind enough to still help me with questions or advice relating to the house. They are good people and they do good work! It’s incredible when you feel like you are going up against a giant and want to give up and can find extraordinary people that will fight for you and never give up!
