Pinellas County / Florida
Safety Harbor
property damage lawyers.
Safety Harbor faces Old Tampa Bay, and a property claim here can involve bayfront water, a long stretch of storm rain, an older house and repair permits handled partly by the city and partly by Pinellas County. Krapf Legal reviews denied, delayed and underpaid claims for Safety Harbor owners. Serving Safety Harbor from our Clearwater office.
Explore damage & claim guidanceWhat the 2024 storms did along Safety Harbor's bayfront
Old Tampa Bay lines the Safety Harbor and Oldsmar shorelines. After the 2024 hurricane season, the city reported significant damage to its Waterfront Park, marina, living shoreline and part of the boardwalk, and said the public pier was swept away. During Helene, the National Weather Service recorded peak water levels generally 4 to 7 feet above mean higher high water along coastal Pinellas County, and the county's evacuations covered zone A and all mobile home parks.
Milton was different here. The National Hurricane Center lists 11.63 inches of rain at a Safety Harbor gauge, while Pinellas water levels generally stayed a foot or less above that datum, with blowout tides. The same report notes that a track shift of less than 30 nautical miles north would have pushed significant surge into Tampa Bay. A Milton dispute in Safety Harbor is therefore more likely to turn on wind, rain and roof or window openings. Damage to a city pier or park does not show what happened inside your building, so document your own property separately.
Hurricane damage claim reviewPermits split between City Hall and Pinellas County
Since May 1, 2021, Safety Harbor's building and inspection work has operated under an interlocal agreement with Pinellas County, which serves as the city's building official. Electrical, plumbing, mechanical and air-conditioning changeout permits, among others, go directly to the county. The county inspects for Florida Building Code compliance, while city staff inspect for the land development code, city code and fire code. For a structure in the Special Flood Hazard Area, the city must first review the work under its 49 percent substantial improvement and damage rule before the application goes to the county.
For an insurance dispute, that means a property's permit history may sit in two places. The city's permit page offers an address search and accepts requests for historical documents, and it routes the closing of an old open, expired permit through a new county application. If an insurer questions the age or condition of a roof, gather the earlier permit, its inspection results and the completion invoice from whichever office holds them. A permit record shows what was approved and inspected; it does not settle whether a new loss is covered.
Roof damage insurance disputesThe 49 percent rule, older houses and flood-policy compliance money
Safety Harbor applies substantial improvement and substantial damage rules at 49 percent of a structure's market value before construction. When the combined cost of improvements reaches that level, the city treats the building as substantially improved, and it must meet Florida Building Code requirements for new structures. The city also notes that several local structures have been judged potentially eligible for the National Register of Historic Places, and it publishes a historic building survey and Florida Master Site File records by street address. If your house appears there, keep that record with the repair file.
A compliance requirement can raise the cost of a repair well beyond the visible damage. The standard flood insurance policy includes Increased Cost of Compliance coverage of up to $30,000 for elevation, floodproofing, relocation or demolition, separate from the building limit but subject to the policy's overall maximum. Its eligibility language refers to flood repair costs equal to or exceeding 50 percent of market value, or to qualifying repetitive losses, with the community enforcing a substantial-damage provision. Because the city's threshold is 49 percent, a determination close to that line should be read carefully against the flood policy before anyone assumes the compliance coverage applies.
Property damage claim legal servicesAlligator Creek map revisions and the city's flood records
The city reports that FEMA is preparing new Flood Insurance Rate Maps for Pinellas County that will affect the Alligator Creek area of Safety Harbor, with the changes expected to take effect in 2027. Owners can compare their current zone with the proposed zone using FEMA's Flood Map Changes Viewer, and appeals or comments go through local officials. Separately, the city's stormwater master plan work has produced maps comparing current FEMA floodplains with a draft 100-year floodplain based on stormwater modeling, and the city invited residents to report conditions the maps miss.
None of those maps decides an insurance claim. The city itself cautions that homeowners insurance does not cover flood damage and that properties outside a mapped flood zone can still flood. What the records can do is help explain where water came from at your address. The city provides elevation certificates on request, depending on availability, and offers flood map determinations for property inside city limits. FEMA's CRS community list effective October 2026 shows Safety Harbor at Class 6, a 20 percent flood premium discount inside the Special Flood Hazard Area.
Water damage claim helpCondo assessments and fires that follow flooding
Section 718.111(11), Florida Statutes, divides insurance and repair responsibilities between a condominium association and its unit owners. A unit-owner policy must include at least $2,000 of loss assessment coverage with a deductible no greater than $250, according to the Department of Financial Services. Section 627.70132 gives loss assessment claims their own timing: notice must be given by the later of 1 year after the date of loss or 90 days after the association votes to levy the assessment, and no later than 3 years after the loss. Keep the board's vote, the assessment notice and the association's claim letters together.
Safety Harbor's hurricane guidance warns that saltwater can damage lithium-ion batteries in electric vehicles, golf carts and small devices, and that resulting fires can start days or weeks after exposure. If a fire followed flooding at your property, preserve evidence of both events: photographs of the water line, the device involved and the fire damage. Flood, homeowners and vehicle policies can treat each stage differently, and the sequence matters to the coverage analysis.

Under section 627.70132, notice of an initial or reopened claim is generally due within 1 year after the date of loss and a supplemental claim within 18 months, with the hurricane's landfall date serving as the date of loss. Section 627.70131 generally requires a residential insurer to acknowledge communications within 7 calendar days and to pay or deny within 60 days after notice, subject to exceptions. That 60-day period is tolled during state-sponsored mediation and when a policyholder does not provide requested material information within 10 days. Residential property mediation through the Department of Financial Services is a pre-appraisal and pre-suit option for eligible disputes.
The general suit period for breach of a property insurance contract is 5 years from the date of loss under section 95.11(2)(e). A flood policy issued through the National Flood Insurance Program instead requires suit in federal court within one year after written denial. Before most property-policy lawsuits, section 627.70152 requires notice through the Department of Financial Services at least 10 business days before filing. Pinellas cases fall within the Sixth Judicial Circuit. Krapf Legal offers a free case evaluation from its only office, at 2790 Sunset Point Road in Clearwater.

Common questions
Your Safety Harbor
questions, answered.
Answers to questions about getting help with a Safety Harbor property insurance claim.
Can I meet with Krapf Legal in Safety Harbor?
Our one physical office is in Clearwater, at 2790 Sunset Point Road, Clearwater, FL 33759. Safety Harbor is a service area for that office. Contact the team to arrange a free case evaluation and to ask how to share your documents.
Who keeps my permit records, the city or Pinellas County?
Possibly both. Since 2021 the county has acted as Safety Harbor's building official and handles many permit types directly, while the city keeps its own reviews and historical files. Request records from each office for the work at issue.
My home is in the Alligator Creek map revision area. Does that change my claim?
A proposed map does not decide what caused a past loss or what a policy covers. It can affect future flood-risk and permitting questions. Keep the comparison printout, but rely on photographs, inspections and the policy for the claim itself.
Will my flood policy pay to elevate the house if the city says I crossed 49 percent?
Maybe, but not automatically. Increased Cost of Compliance coverage pays up to $30,000 when the policy's eligibility terms are met, and those terms refer to a 50 percent repair-cost level or qualifying repeat losses. Have the determination and policy reviewed together.
How long do I have to report a condo special assessment to my insurer?
Under section 627.70132, notice of a loss assessment claim is due by the later of 1 year after the loss or 90 days after the association votes to levy the assessment, and never more than 3 years after the loss. Check your unit policy's own reporting terms too.
Is it too late to report 2024 hurricane damage for the first time?
For Helene and Milton, the ordinary 1-year notice period for a new claim and the 18-month period for a supplemental claim, both measured from landfall, have run. An existing timely claim, a statutory exception or a federal flood policy may need separate analysis.
Does a slow or low payment mean the insurer acted in bad faith?
Not by itself. Section 624.1551 requires an adverse court adjudication of breach and a final judgment against the property insurer before the statutory extracontractual action may go forward. The coverage and payment dispute is reviewed first.

See all reviews on GoogleThis firm was professional, responsive and handled my situation well. I also feel their billing was reasonable. Robert Studor and his staff were great to work with.
Absolutely phenomenal work and effort. They worked to help us fight our insurance company that refused to pay us what was owed, and got us a fair settlement. Hopefully I will never need a lawyer again but if I did, this is who I would call.
Robert was attentive and updated us along the route. Any questions I texted were answered quickly. We’re ver satisfied.
I luckily chose Keller Fisher of Krapf Legal for my roof damage claim. He was smart, responsive and knew what needed to be done. I would highly suggest working with Keller.

Kristen and her team were fantastic She took the time to listen to our concerns over our claim from hurricane Ian and provided us with solid advice on how to proceed. She responded to our request and in the end got us the settlement we were looking for to repair the damage that it caused. You could tell through the multiple conversations that she really looks out for her clients interests I would highly recommend her and Kraph Legal for any insurance issues that you may have They are definitely well worth money spent Extremely Satisfied
A very well run law firm if you have a gripe with your homeowners insurance.
After our insurance company dismissed our hurricane-caused roof damage/leak claim as "age-related deterioration/wear and tear". we were referred to Krapf Legal. The Krapf Legal team were exceptional throughout the year-long battle to ensure we were compensated for our significant losses. Our attorney, Tim Delaney, was always reachable, professional and courteous - and he negotiated the exact settlement we were looking for to cover 100% of our roof replacement.
Dear family and friends, I highly recommend Mike Keeler from The Claim Squad and Geoffrey Schuessler from Krapf Legal for their exceptional service in handling my homeowner's insurance claim. Their professionalism and expertise were remarkable, especially considering the new laws that have become increasingly burdensome to homeowners since January 1st, 2023. Throughout the process, both Mr. Keeler and Mr. Schuessler demonstrated honesty and forthrightness, which I found commendable. I am grateful for their efforts in resolving my insurance claim and impressed by their dedication to their work and clients. If you need assistance with an insurance claim, I highly recommend the services of Mr. Keeler and Mr. Schuessler. Their expertise and professionalism are second to none, and I am confident that they will provide exceptional service to all. Thank you for your attention to this matter. Best regards, Taylor Taylor
In a time where we had lost hope, Keller Fisher from Krapf Legal stepped in and led us to a settlement that would allow my widowed mother in law to get the repairs that were much needed on her roof. We were denied the claim twice. We called Krapf Legal and within no time they had begun a claim with my insurance company and got it settled. Keller was professional, courteous, prompt, and available with any questions or concerns we had. I'd recommend this gentleman to anyone who is experiencing issues with their insurance company. I can't thank Keller enough for all the hard work he and his team put forth in to getting this case settled.

I had a great experience using Krapf Legal to help me settle my home insurance claim. I had provided my insurance company with everything they requested, but their offer was way less than the estimates I had to fix the damage to my house I had been waiting for almost a year for the insurance company to respond to my claim. I called Grant and he said he would take care of it, and he did! The team at Krapf legal was able to quickly settle my claim.

Mr Kraft is incredible !! Gave me his cell phone number, so I could speak with him at any time. Explained in detail any questions I had and never sugar coated anything. He's a straight shooter. I highly recommend Mr Kraft for your Social Security Disability needs.
Our home has survived many Florida hurricanes but when a strong, surprise hail storm hit in early 2020, our house suffered substantial damage. Our homeowner’s insurance company had a team of experts on their side to fight our claim. When weeks turned into months, we knew we needed someone to represent our needs. Krapf Legal came highly recommended and we now understand why this team has earned its outstanding reputation. Every Krapf Legal representative has been so professional, understanding and so passionate about helping homeowners like us. While we live several miles away in another city, the Krapf legal team (Grant, Keller and the entire team) treated us like neighbors. They were professional, responsive and spot on with their advice. In the end, we received the compensation we needed to repair our home. Truly, we couldn’t have resolved our claim with such a positive outcome without Krapf Legal. Thank you!!!
Seriously the best property insurance attorney there is. Highly recommend!

Excellent company with superb customer service!
The team at Krapf Legal is a group of dedicated professionals that bring significant contribution and value to their clients. They are highly responsive, communicate expectations effectively and more importantly, get timely results for the folks that they represent. I highly recommend this firm, whether working with them directly or through a public adjuster.
I had extensive damage to my home from Hurricane Irma. My insurance company only stated $8k worth of damage but because my deductible was so high they sent me a check for $3k! I couldn't even get the insurance company to return my phone call for 3 months! I didn't know what to do so I hired an insurance adjuster to fight the claim. After over a 16mths of fighting it had finally gotten to the point to bring in a lawyer. They recommended Grant Krapf and I’m so glad they did! I couldn’t believe how quickly he got a response from the insurance company. In total, I had been waiting for nearly 2 years and when Grant and his team came on board it was a matter of months before they were able to get the insurance company to settle. I was shocked and amazed! I have never hired an attorney before and I had always heard unflattering stories but this was not my experience. Even after the settlement they have been kind enough to still help me with questions or advice relating to the house. They are good people and they do good work! It’s incredible when you feel like you are going up against a giant and want to give up and can find extraordinary people that will fight for you and never give up!
Highly recommend Krapf Legal. Cailtin has always greeted us in a friendly and professional manner and made us feel like a very important client. Grant and his staff were always prompt to address our needs and timely respond to any questions. Very knowledgable, respectful, reliable, courteous and professional.
Grant and his team consistently achieve great results for their clients. They are people you can trust and always act in their client’s best interest.
