Seminole
property damage lawyers.

A Seminole insurance dispute often turns on where the water came from and which government holds the building records. Krapf Legal reviews denied, delayed and underpaid property claims against the policy, the inspection findings and the repairs still needed. Serving Seminole from our Clearwater office.

01

Confirm whether the property is inside Seminole's city limits

The City of Seminole lists its own area as 5.63 square miles, while describing the surrounding "Greater Seminole" area as approximately 20 square miles. A Seminole mailing address therefore does not settle which government issued the last roof permit or keeps the floodplain file for a home. Pinellas County explains that property outside city limits is unincorporated and receives services from the county, and it offers an address lookup for owners who are unsure.

Settle the jurisdiction before requesting records, because a search in the wrong permit system can come back empty and leave a gap in the repair history. The city publishes a City Limits Map through its Community Development Department. When we review a denied or reduced claim, we want to know which office approved the last roof, window or addition work and whether a final inspection was recorded. An empty search result does not prove that work was unpermitted; write down where you looked.

Lake Seminole, Long Bayou and Cross Bayou: name the water source

Seminole's flood protection page says flooding in the city may come from rising water in Long Bayou, Cross Bayou and Lake Seminole, or from the ditches and streams that feed them. The city estimates that about 11% of Seminole properties lie within the 100-year floodplain. That figure describes mapped risk across the city. It does not tell an insurer, or anyone else, how water reached a particular living room or which policy should respond.

The Department of Financial Services states that flood damage is not covered by a homeowners policy, and describes flood as including overflow of inland or tidal waters and surface-water runoff. Seminole participates in the National Flood Insurance Program, so some owners carry a separate NFIP policy with its own federal conditions. If water rose from a lake or bayou edge, say so plainly, and keep that account apart from evidence of a roof opening or a failed supply line. Our attorneys match each source of water to the policy that could cover it.

03

Drain backups and heavy rain call for an endorsement check

Seminole's flood page suggests that owners whose flooding problem involves sewer backup consider adding a sewer backup rider to the homeowners policy. The Department of Financial Services likewise notes that some homeowners policies exclude water backing up from an outside sewer or drain unless an endorsement was purchased. When a Seminole claim is denied because water came up through a floor drain, toilet or shower, the declarations page and the endorsement list are the first documents to pull.

The National Weather Service's Milton summary reports roughly 10 to 15 inches of rain across much of Pinellas County in October 2024, with heavier pockets in the southern and southeastern parts of the county. That county range is background, not a reading taken at your house. Photograph the fixture or drain where water appeared, keep any plumber's written findings, and note whether the yard or street was holding water at the same time. Those details help separate a backup question from a surface-water or roof-entry question.

04

Seminole re-roof inspections leave a useful paper trail

Seminole's Building Division handles permit issuance, plan review and field inspections from City Hall at 9199 113th Street, and its online portal includes a permit search. The city's notice to roofing contractors describes in-progress inspections on re-roof work and says photographs substitute only when the inspector allows it. Those photographs must show every roof section, including underlayment overlap, valleys, drip edge, penetrations and the shingle fastening pattern.

Those same details often come up when an insurer attributes roof damage to age, installation or wear. Ask for the permit history for the address, including in-progress and final inspection results for the current roof, and keep the installer's invoice. Section 627.70131 requires an adjuster who physically inspects the property to give you a document with his or her name and state license number, and requires the insurer to send a copy of any detailed estimate within 7 days after its adjuster generates it. File those papers next to the city record.

05

Substantial damage, code upgrades and ordinance coverage

Seminole states that floodplain additions, improvements and repairs equal to or exceeding 50 percent of a structure's market value must meet new-construction requirements, including a lowest floor no lower than one foot above the base flood elevation. The Community Development Department keeps floodplain maps and elevation certificates for selected properties at City Hall. If a repair estimate approaches that threshold, ask the city in writing what it will require before the scope is fixed.

Section 627.7011 requires insurers to offer homeowners replacement-cost coverage that includes costs to meet laws and ordinances, with the added amount limited to 25 or 50 percent of the dwelling limit as selected. A policy is deemed to include the 25 percent level unless the owner rejected it in writing on an approved form. Whether those dollars apply depends on the policy, any signed rejection and the actual city requirement. We compare the contractor's code-driven line items with the endorsement instead of assuming every upgrade is payable.

Seminole claim deadlines and the next step from Clearwater

Section 627.70132 generally bars an initial or reopened claim unless notice reached the insurer within 1 year after the date of loss, and a supplemental claim unless notice was given within 18 months. For hurricanes and other weather events, the statute fixes the date of loss as the landfall date or the date NOAA verifies the event. Under section 627.70131, the insurer generally must pay or deny within 60 days after notice, give a reasonable written explanation of the basis, and explain in writing any payment that is less than its own detailed estimate.

A suit for breach of a property insurance contract generally must be filed within 5 years of the loss under section 95.11(2)(e). Where section 627.70152 applies, a notice of intent goes through the Department of Financial Services at least 10 business days before suit and only after the insurer's coverage determination. Pinellas County is part of the Sixth Judicial Circuit, and NFIP flood disputes follow separate federal rules. Krapf Legal reviews Seminole claims from its single office at 2790 Sunset Point Road in Clearwater.

Common questions

Your Seminole
questions, answered.

Answers to questions about getting help with a Seminole property insurance claim.

Does Krapf Legal have an office in Seminole?

No. Seminole is a service area for our office at 2790 Sunset Point Road, Clearwater, FL 33759. Contact the Clearwater team to arrange a free case evaluation and to ask how to send the policy, photographs and insurer letters for review.

My address says Seminole, but the city shows no permit for my roof. Is that a problem?

Not necessarily. The Greater Seminole area is much larger than the city itself, and unincorporated properties are served by Pinellas County. Confirm the jurisdiction, search the correct permit system, and record the result before drawing conclusions about the roof's history.

Does living near Lake Seminole make my water claim a flood claim?

Proximity describes risk, not cause. The evidence at the house decides the question: where water entered, when, and whether it rose from the ground or came through the roof or plumbing. Provide that evidence along with every policy that might apply.

My insurer denied water that came up through a floor drain. Where should I start?

Pull the declarations page and look for a water backup or sewer backup endorsement, since some homeowners policies exclude that loss without one. Keep the plumber's findings and photographs of the fixture, and bring the denial letter so the stated reason can be reviewed.

Can my insurer blame installation problems for storm damage to my roof?

An insurer may take that position, and the city's inspection records can help test it. Gather the permit, any in-progress and final inspection results, the installer's invoice and earlier photographs, then compare them with the adjuster's specific findings.

Am I entitled to see the adjuster's estimate?

Section 627.70131 requires the insurer to send you a copy of any detailed estimate within 7 days after its adjuster generates one, although it does not require a detailed estimate in every claim. If the payment is below that estimate, the insurer must explain the difference in writing.

Can I still report Hurricane Milton damage for the first time?

For an October 2024 hurricane loss, the ordinary 1-year notice period and the 18-month supplemental period, both measured from landfall, have already run. A claim reported on time, a statutory exception or an NFIP policy raises different questions that need individual review.

Will the insurer have to pay my attorney fees if the claim succeeds?

Do not count on it. The 2022 reforms removed the former one-way fee entitlement for residential and commercial property policies, though older policies can require separate analysis. Ask for the written fee agreement and an explanation of costs before deciding how to proceed.

Absolutely phenomenal work and effort. They worked to help us fight our insurance company that refused to pay us what was owed, and got us a fair settlement. Hopefully I will never need a lawyer again but if I did, this is who I would call.

After our insurance company dismissed our hurricane-caused roof damage/leak claim as "age-related deterioration/wear and tear". we were referred to Krapf Legal. The Krapf Legal team were exceptional throughout the year-long battle to ensure we were compensated for our significant losses. Our attorney, Tim Delaney, was always reachable, professional and courteous - and he negotiated the exact settlement we were looking for to cover 100% of our roof replacement.

Dear family and friends, I highly recommend Mike Keeler from The Claim Squad and Geoffrey Schuessler from Krapf Legal for their exceptional service in handling my homeowner's insurance claim. Their professionalism and expertise were remarkable, especially considering the new laws that have become increasingly burdensome to homeowners since January 1st, 2023. Throughout the process, both Mr. Keeler and Mr. Schuessler demonstrated honesty and forthrightness, which I found commendable. I am grateful for their efforts in resolving my insurance claim and impressed by their dedication to their work and clients. If you need assistance with an insurance claim, I highly recommend the services of Mr. Keeler and Mr. Schuessler. Their expertise and professionalism are second to none, and I am confident that they will provide exceptional service to all. Thank you for your attention to this matter. Best regards, Taylor Taylor

In a time where we had lost hope, Keller Fisher from Krapf Legal stepped in and led us to a settlement that would allow my widowed mother in law to get the repairs that were much needed on her roof. We were denied the claim twice. We called Krapf Legal and within no time they had begun a claim with my insurance company and got it settled. Keller was professional, courteous, prompt, and available with any questions or concerns we had. I'd recommend this gentleman to anyone who is experiencing issues with their insurance company. I can't thank Keller enough for all the hard work he and his team put forth in to getting this case settled.

I had a great experience using Krapf Legal to help me settle my home insurance claim. I had provided my insurance company with everything they requested, but their offer was way less than the estimates I had to fix the damage to my house I had been waiting for almost a year for the insurance company to respond to my claim. I called Grant and he said he would take care of it, and he did! The team at Krapf legal was able to quickly settle my claim.

Our home has survived many Florida hurricanes but when a strong, surprise hail storm hit in early 2020, our house suffered substantial damage. Our homeowner’s insurance company had a team of experts on their side to fight our claim. When weeks turned into months, we knew we needed someone to represent our needs. Krapf Legal came highly recommended and we now understand why this team has earned its outstanding reputation. Every Krapf Legal representative has been so professional, understanding and so passionate about helping homeowners like us. While we live several miles away in another city, the Krapf legal team (Grant, Keller and the entire team) treated us like neighbors. They were professional, responsive and spot on with their advice. In the end, we received the compensation we needed to repair our home. Truly, we couldn’t have resolved our claim with such a positive outcome without Krapf Legal. Thank you!!!

I had extensive damage to my home from Hurricane Irma. My insurance company only stated $8k worth of damage but because my deductible was so high they sent me a check for $3k! I couldn't even get the insurance company to return my phone call for 3 months! I didn't know what to do so I hired an insurance adjuster to fight the claim. After over a 16mths of fighting it had finally gotten to the point to bring in a lawyer. They recommended Grant Krapf and I’m so glad they did! I couldn’t believe how quickly he got a response from the insurance company. In total, I had been waiting for nearly 2 years and when Grant and his team came on board it was a matter of months before they were able to get the insurance company to settle. I was shocked and amazed! I have never hired an attorney before and I had always heard unflattering stories but this was not my experience. Even after the settlement they have been kind enough to still help me with questions or advice relating to the house. They are good people and they do good work! It’s incredible when you feel like you are going up against a giant and want to give up and can find extraordinary people that will fight for you and never give up!
