Tarpon Springs
property damage lawyers.
Tarpon Springs claims often raise questions that other Pinellas cities do not: Gulf surge along the coast south of the Anclote River, historic homes around Spring Bayou, and city letters about storm-repair permits. Krapf Legal reviews denied, delayed and underpaid property insurance claims for these properties. Serving Tarpon Springs from our Clearwater office.
Explore damage & claim guidanceHelene's surge and Milton's rain left different evidence in Tarpon Springs
The National Hurricane Center's report on Helene describes maximum storm surge inundation of 5 to 7 feet above ground level from the Anclote River southward to Longboat Key. A USGS sensor at Fred Howard Park, the county's Gulf-front park in Tarpon Springs, measured 7.23 feet above mean higher high water, with significant waves on top. About two weeks later, the same agency's Milton report lists 11.10 inches of rain at a Tarpon Springs gauge, while the National Weather Service describes Pinellas coastal water levels during Milton as generally a foot or less above that tidal datum, with blowout tides.
For many Tarpon Springs homes, a Helene file is therefore mostly about rising saltwater, and a Milton file is mostly about wind, rain and roof or window openings. Homeowners policies generally treat flood separately, and the state's consumer guidance notes that owners near the water may have both a flood claim and a windstorm claim. Keep high-water mark photographs apart from ceiling stains and roof photographs taken after the second storm, so each insurer can be asked to address the damage its policy actually concerns.
Hurricane damage claim reviewAnswer the city's storm-damage permit letter with your claim file in hand
Tarpon Springs has mailed a Storm Damage Permit Requirement Letter to homes in the Special Flood Hazard Area that the city believed were damaged by Debby, Helene or Milton but had no repair permit on file. The letter asks the owner to contact the Building Department within 60 days of receiving it. The city also says repairs already completed without a permit still need an after-the-fact storm damage permit, and that only the storm damage permit fee applies to that permit.
The permit review compares repair cost with the structure's value under the FEMA 50 percent rule. The city points owners to the Pinellas County Property Appraiser's FEMA/WLM letter for a starting value and accepts only a FEMA 50% Rule actual cash value appraisal, not an ordinary appraisal, if an owner wants a different figure. Because the city and your insurer may both receive repair numbers, keep one documented scope and explain any difference between the contractor's estimate and the insurer's estimate rather than presenting inconsistent totals.
If the city requires work beyond a like-for-like repair, check the policy's law and ordinance coverage. Section 627.7011, Florida Statutes, requires insurers to offer it, and unless the owner rejected it in writing, a homeowners policy is deemed to include that coverage at 25 percent of the dwelling limit. Limits, conditions and exclusions in the actual policy still control.
Property damage claim representationHistoric district rules can change what a matching repair costs
Tarpon Springs has a National Register downtown historic district, the Greektown National Register Traditional Cultural Property District and a local historic district that includes downtown. The city's design review manual says approval from the Heritage Preservation Board is required before work that needs a building permit, or any project affecting a property within a designated district. Ordinary maintenance that does not replace materials or alter finishes does not need that approval. The manual traces the earliest and largest homes to the area around Spring Bayou between 1883 and 1905, with most district buildings dating from 1905 to 1935.
Those guidelines reach roof work directly: repairs to isolated sections must match the existing roof in material, style, size and color, and a full replacement must match the existing material or suit the building's style. Section 626.9744, Florida Statutes, addresses matching when a homeowners policy settles on repair or replacement cost and replaced items do not match in quality, color or size; the insurer must make reasonable repairs or replacement in adjoining areas, weighing cost, achievable uniformity and remaining useful life. Bring any board conditions and the contractor's explanation of how they affect the scope, since neither rule automatically requires replacing an entire roof.
Roof damage insurance disputesElevation and flood-zone records for bayou and Gulf-side homes
Tarpon Springs says it holds elevation certificates only for building-compliance work completed since the late 1990s; it does not have certificates for older construction or for certificates prepared solely for flood insurance. Search the city's public records portal and the county's flood map application, or ask a licensed surveyor to prepare a new certificate. The city reports improving to Community Rating System Class 5, and FEMA's CRS community list effective October 2026 shows Tarpon Springs at Class 5 with a 25 percent flood premium discount in the Special Flood Hazard Area. That discount affects premiums, not whether a particular loss is paid.
Low ground near the water deserves its own documentation. The city's Craig Park seawall project describes sidewalks along Spring Bayou at roughly 2 feet above mean sea level and adds check valves to keep tidal water from backing into the park's drains. If water reached a nearby home, record where it entered. The city's recovery guidance also advises photographing damage first and keeping samples of damaged carpet, insulation and contents until the adjuster inspects. Mold questions are easier to evaluate when that moisture history is preserved.
Mold insurance claim disputesFlorida timing rules that shape a Tarpon Springs dispute
Section 627.70132, Florida Statutes, generally bars an initial or reopened property claim unless notice is given within 1 year after the date of loss, and a supplemental claim unless notice is given within 18 months. For hurricane claims, the statute treats the date of loss as the date the hurricane made landfall. A supplemental claim covers additional loss from the same peril the insurer already adjusted, or costs incurred while completing repairs under an open, timely reported claim.
Section 627.70131 sets the insurer's side of the process. Subject to exceptions and tolling, the insurer generally acknowledges claim communications within 7 calendar days, gives the name and license number of the adjuster who inspects, conducts any physical inspection within 30 days after receiving proof-of-loss statements, sends a copy of a detailed estimate within 7 days after its adjuster generates one, and pays or denies within 60 days after notice with a written explanation.
A lawsuit for breach of a property insurance contract generally must be filed within 5 years from the date of loss under section 95.11(2)(e); that period does not extend the notice deadlines. A National Flood Insurance Program policy is different: the standard policy requires a signed proof of loss within 60 days after the loss and a federal-court suit within one year after a written denial.
Bringing a Tarpon Springs claim to our Clearwater office
Start with the insurer's decision letter, the policy and every estimate, then add the city documents tied to the address: any storm-damage permit letter, permit applications, elevation certificate and historic-district approvals. Our attorneys compare the reasons given for a denial or reduced payment with the evidence and the policy language. The free case evaluation is a discussion of the file and of possible representation terms; it is not a prediction of any recovery.
Where section 627.70152 applies, a policyholder must give written notice of intent to sue through the Florida Department of Financial Services at least 10 business days before filing, and not before the insurer has made a coverage determination. Pinellas County cases are in the Sixth Judicial Circuit, and the correct court depends on the dispute. Krapf Legal has one physical office, at 2790 Sunset Point Road in Clearwater, and serves Tarpon Springs owners from there.

Common questions
Your Tarpon Springs
questions, answered.
Answers to questions about getting help with a Tarpon Springs property insurance claim.
Does Krapf Legal have an office in Tarpon Springs?
No. Our only physical office is at 2790 Sunset Point Road, Clearwater, FL 33759, and Tarpon Springs is one of the communities we serve from it. Call to arrange a free case evaluation and ask how to send your claim documents.
I received a storm-damage permit letter from the city. Does it affect my insurance claim?
The letter is a permitting matter, not a coverage decision. The repair cost you report to the city and the scope your insurer reviews should be consistent and explained. Keep the letter, any permit filings and the valuation used for the 50 percent review with your claim records.
Does the historic district require my insurer to pay for a whole new roof?
Not automatically. The city's guidelines require repairs to match the existing roof, and Florida's matching statute requires reasonable repair or replacement in adjoining areas when replaced items do not match. How far that reaches depends on the policy, the damage and the facts.
My house predates the city's elevation certificate records. What can I use?
Check the county's flood map application and your own closing or insurance papers first. If no certificate exists, a licensed surveyor, engineer or architect can prepare one. Elevation data helps describe flood risk; it does not by itself establish how a particular loss happened.
Can I still report new Helene or Milton damage?
For these 2024 hurricanes, the ordinary 1-year notice period for a new claim and the 18-month period for a supplemental claim, both counted from the landfall date, have already run. Have a lawyer review any existing claim, exception or flood-policy question rather than assuming late notice is accepted.
My insurer paid less than its own adjuster's estimate. Is that allowed?
Section 627.70131 requires the insurer to give a reasonable written explanation when its claim payment is less than its own detailed estimate of the loss. Ask for that explanation and a copy of the estimate, then compare both with your contractor's scope.
Will the insurance company pay my attorney fees if I win?
Do not assume so. The 2022 reforms removed the former one-way attorney-fee entitlement for residential and commercial property policies, although older policies and other fee rules may need separate review. Ask about the written fee agreement and case expenses before deciding.

See all reviews on GoogleThis firm was professional, responsive and handled my situation well. I also feel their billing was reasonable. Robert Studor and his staff were great to work with.
Absolutely phenomenal work and effort. They worked to help us fight our insurance company that refused to pay us what was owed, and got us a fair settlement. Hopefully I will never need a lawyer again but if I did, this is who I would call.
Robert was attentive and updated us along the route. Any questions I texted were answered quickly. We’re ver satisfied.
I luckily chose Keller Fisher of Krapf Legal for my roof damage claim. He was smart, responsive and knew what needed to be done. I would highly suggest working with Keller.

A very well run law firm if you have a gripe with your homeowners insurance.
After our insurance company dismissed our hurricane-caused roof damage/leak claim as "age-related deterioration/wear and tear". we were referred to Krapf Legal. The Krapf Legal team were exceptional throughout the year-long battle to ensure we were compensated for our significant losses. Our attorney, Tim Delaney, was always reachable, professional and courteous - and he negotiated the exact settlement we were looking for to cover 100% of our roof replacement.
Dear family and friends, I highly recommend Mike Keeler from The Claim Squad and Geoffrey Schuessler from Krapf Legal for their exceptional service in handling my homeowner's insurance claim. Their professionalism and expertise were remarkable, especially considering the new laws that have become increasingly burdensome to homeowners since January 1st, 2023. Throughout the process, both Mr. Keeler and Mr. Schuessler demonstrated honesty and forthrightness, which I found commendable. I am grateful for their efforts in resolving my insurance claim and impressed by their dedication to their work and clients. If you need assistance with an insurance claim, I highly recommend the services of Mr. Keeler and Mr. Schuessler. Their expertise and professionalism are second to none, and I am confident that they will provide exceptional service to all. Thank you for your attention to this matter. Best regards, Taylor Taylor
In a time where we had lost hope, Keller Fisher from Krapf Legal stepped in and led us to a settlement that would allow my widowed mother in law to get the repairs that were much needed on her roof. We were denied the claim twice. We called Krapf Legal and within no time they had begun a claim with my insurance company and got it settled. Keller was professional, courteous, prompt, and available with any questions or concerns we had. I'd recommend this gentleman to anyone who is experiencing issues with their insurance company. I can't thank Keller enough for all the hard work he and his team put forth in to getting this case settled.

I had a great experience using Krapf Legal to help me settle my home insurance claim. I had provided my insurance company with everything they requested, but their offer was way less than the estimates I had to fix the damage to my house I had been waiting for almost a year for the insurance company to respond to my claim. I called Grant and he said he would take care of it, and he did! The team at Krapf legal was able to quickly settle my claim.

Our home has survived many Florida hurricanes but when a strong, surprise hail storm hit in early 2020, our house suffered substantial damage. Our homeowner’s insurance company had a team of experts on their side to fight our claim. When weeks turned into months, we knew we needed someone to represent our needs. Krapf Legal came highly recommended and we now understand why this team has earned its outstanding reputation. Every Krapf Legal representative has been so professional, understanding and so passionate about helping homeowners like us. While we live several miles away in another city, the Krapf legal team (Grant, Keller and the entire team) treated us like neighbors. They were professional, responsive and spot on with their advice. In the end, we received the compensation we needed to repair our home. Truly, we couldn’t have resolved our claim with such a positive outcome without Krapf Legal. Thank you!!!
Seriously the best property insurance attorney there is. Highly recommend!

Excellent company with superb customer service!
The team at Krapf Legal is a group of dedicated professionals that bring significant contribution and value to their clients. They are highly responsive, communicate expectations effectively and more importantly, get timely results for the folks that they represent. I highly recommend this firm, whether working with them directly or through a public adjuster.
I had extensive damage to my home from Hurricane Irma. My insurance company only stated $8k worth of damage but because my deductible was so high they sent me a check for $3k! I couldn't even get the insurance company to return my phone call for 3 months! I didn't know what to do so I hired an insurance adjuster to fight the claim. After over a 16mths of fighting it had finally gotten to the point to bring in a lawyer. They recommended Grant Krapf and I’m so glad they did! I couldn’t believe how quickly he got a response from the insurance company. In total, I had been waiting for nearly 2 years and when Grant and his team came on board it was a matter of months before they were able to get the insurance company to settle. I was shocked and amazed! I have never hired an attorney before and I had always heard unflattering stories but this was not my experience. Even after the settlement they have been kind enough to still help me with questions or advice relating to the house. They are good people and they do good work! It’s incredible when you feel like you are going up against a giant and want to give up and can find extraordinary people that will fight for you and never give up!
Highly recommend Krapf Legal. Cailtin has always greeted us in a friendly and professional manner and made us feel like a very important client. Grant and his staff were always prompt to address our needs and timely respond to any questions. Very knowledgable, respectful, reliable, courteous and professional.
Grant and his team consistently achieve great results for their clients. They are people you can trust and always act in their client’s best interest.
